Justice Roberts: Can the government make you buy a cell phone?

Opponents of the individual mandate provision of President Obama's health care law contend that if the government can force you to buy health insurance, its powers of compulsion are virtually unlimited. Chief Justice John Roberts wonders what else Washington can force citizens to buy in this exchange:

CHIEF JUSTICE ROBERTS: Well, the same, it seems to me, would be true say for the market in emergency services: police, fire, ambulance, roadside assistance, whatever. You don't know when you're going to need it; you're not sure that you will. But the same is true for health care. You don't know if you're going to need a heart transplant or if you ever will. So there is a market there. To -- in some extent, we all participate in it. So can the government require you to buy a cell phone because that would facilitate responding when you need emergency services? You can just dial 911 no matter where you are?

GENERAL VERRILLI: No, Mr. Chief Justice. think that's different. It's -- We -- I don't think we think of that as a market. This is a market. This is market regulation. And in addition, you have a situation in this market not only where people enter involuntarily as to when they enter and won't be able to control what they need when they enter but when they --

What the hell is this "market" baloney and what does it have to do with the question asked: Can the government force you to buy a cell phone... or a toaster (you need food) or a windmill (we all have to participate to make the 'green energy' market effective)

Cell Phones, burials....none are directly related.

CHILDBIRTH IS.

The government is arguing that if you don't buy health insurance, you MAY burden the state with unpaid healthcare costs down the road.

But if you "choose" to have a child, the government will easily be able to make the case that you will be adding to the costs of society for infrastructure, for trash collection, for the CO2 that your child will breathe out.

Thus, the government should be able to have a say in who gives birth, how many times, and which ones.

With 154 million workers and 5.2 million pregnancies a year....

$1 a month from each of the workers in the abortion care program will generate $360 a year per pregnancy... Abortions cost $350, at the end of the day enough to terminate every pregnancy in the coverage group.

GENERAL VERRILLI: No, Mr. Chief Justice....I don't think we think of that as a market.

Verizon, AT&T Wireless, Sprint, etc. all better immediatly file suits in federal court stating they no longer should be governed by federal regulation, since cell phone service isn't, by the government's admission in open court, a "market," and therefore is not subject to the interstate commerce clause of the US Constitution.

There are ways around it.

If they imposed that where I am, I’d simply violate the law in a way they couldn’t catch me.

However, it does point to what the next item of control will be - water. One of the most abundant substances on earth, will be rationed and taxed.

It already did that - Wickard v. Filburn The farmer in that case was prohibited from growing food for himself because it would have "a substantial effect" upon interstate commerce. W v. F also needs to be overturned - and this case may be the mechanism for that. So I pray.

The communist USA government is already forcing us to buy cell phones for people THEY have determined need them. It matters not if these people are in need because of circumstances beyond their control or in most cases due to a life time of dumb, stupid life decisions.

Somehow, the communists gained control and now feel cell phones are a right and we must pay for them.

Bingo! This case lays bear the lie that is modern commerce clause jurisprudence and hopefully leads to a retrenchment and resurrection of the rights reserved to the States and the people. Let's insist on it in November. Shall we?

Which is why it’s hard to get that passionate about overturning the individual mandate. I already pay an obscene amount of tax and those taxes have no option attached to be exempt from them if I go out and buy something for myself. How about if I buy my own cell phone, I can get the cut of my taxes back that goes to pay for other people’s cell phones?

Which is why the individual mandate Newt used to talk about had the option to post a bond instead of getting insurance. So if you set your own money aside you wouldn't need to buy insurance.

This being the decision that will determine whether we shall continue to be a Republic, or Socialist/Marxist state, then the Jury is still out.

Personally, I think they will at best, sever the mandate, and leave the complete socialist power structure on place. The mandate portion will just be passed on to the state to work out, since Romney has proved that part to be constitutional.

If I was a Congressman and the individual mandate does not get tossed out by the SCOTUS I would introduce legislation that every adult American citizen be FORCED to buy a firearm.

Shove it down their throats.

Correct. Our family uses a chiropractor and, thanks to ObamaCare's mandates, my work insurance greatly reduced these type of coverages so they could cover the cost of treating winos, junkies, illegal aliens and other ObamaCare mandates.

We asked him about it and he said that by the time the insurance paperwork is done, he only ends up getting about what our previous co-pay was anyway. So we arranged treatment without insurance for the former copay amount, cash on the table.

EXACTLY! When I was young and somewhat a little "poorer" I saved and paid cash for our family office visits and I even paid cash for the birth of my 4th child. Believe me, I got discounts when I flashed cash at the doctors office staff. They even worked hard to be sure I got the "samples" instead of sending me off to the pharmacy. Worked well for me.

Now, I will admit it is a bit risky if you end up in the hospital or with something serious. I think I was in my 30's when I went with a high deductible catastrophic plan.

Exactly, therefore my question to Roberts - how is being forced by the government to purchase a necessity any less intrusive than being forced by the government to purchase any non necessity?

IOW, how can Wickard (and Raich) stand if the court rules against Abomicare? Further, how can Social Security remain constitutional?

Or demand of all Republican Senate candidates that they take an oath not to approve under ANY circumstance any candidate for the bench who does not specifically repudiate Wickard v Filburn, the ObamaCare Case and all the commerce clause chicanery.
