No need. Instead, they're simply engaging in parallel processing. There are two separate programs running at the same time: The Rule of Law, which operates under the Constitution, and the Rule of Obama, which ignores and/or deliberately undermines any laws not to his taste. He is gradually working toward his ultimate goal, which is to take the Rule of Law permanently off-line.

It was appropriate that the 5th Circuit carry out this politically delicate, but necessary, task. It saved SCOTUS from getting into the fray and possibly tarnishing its perceived impartiality.

Well...the courts need to take a stand in Obama’s political war against the constitutional authority of the courts. If they are silent, they lose their power as a co-equal branch of government to a Marxist.
Mr. Obama is playing with fire. The courts can scalp him if judges and attorneys see their power slipping away. They are as power hungry as he is.
The answer is: no, he has not.
This whole contretemps reminds me of a curious finding by Stanley Kurtz, reported in his book "Radical-in-Chief".
Attempting to discover who Obama really was, Kurtz interviewed everybody he'd ever worked for. Seems that Obama never completed anything he started and left every job he ever had complaining of "not having enough power."
Having left one job, he then sought a post which would give him more power. That's why he went to Harvard, for example -- because a Harvard degree would allow him to accrue "more power."
The progression from community organizer to the State Senate, to the U.S. Senate to the Presidency was all a part of this quest for "more power."
From this, it is obvious that Obama's concept of "power" is childlike -- that of a juvenile's. In his mind, power isn't earned, persuasion and trust aren't integral to it. Instead, it is conferred by one's office.
To Obama, "power" is defined by making people do what you want them to do. All you have to do is issue a command. And, now, he inhabits the most powerful office in the free world. The "power" is his.
And he believes the SCOTUS should do his bidding. He has commanded them to do so. And he cannot conceive why they would deny him.
Of course, he will ignore their ruling!
This ignorant man-child is going to bring serious trouble down on all our heads.

What Obama did was perfectly legal, but unethical. Thugish. We would never see George Bush try to spin a court case while judges are contemplating its outcome. He had respect for the American system and those with opposing ideas.
