Exclusive: Charla Nash’s Lawyer Blames State For Chimp Attack, Seeks $150 Million

STAMFORD, Conn. (CBSNewYork) - Charla Nash is still recovering from a face transplant and wants to sue the state of Connecticut over the chimpanzee attack that nearly killed her three years ago, WCBS 880 Connecticut Bureau Chief Fran Schneidau reports exclusively.

On February 16, 2009, a 200-pound chimpanzee named Travis was freely roaming the grounds of the Stamford home of his owner, and Nash’s friend, Sandra Herold when Nash visited.

The chimp attacked Nash, causing her to lose her ears, eyes, hands, and nose in the aftermath.

Bridgeport attorney Charles Willinger, who represents Nash, exclusively told Schneidau that he believes that the near-fatal mauling could have been avoided.

He said the state Department of Energy and Environmental Protection ignored its own regulations regarding private ownership of potentially dangerous animals.

Interesting, no comment from the state or media about that at all. I don't agree with the lawsuit, but no heads are rolling either.

Exactly.A few years back there was a nasty fire at a nightclub in Rhode Island in which 100 kids were killed.Neither the band (which was largely at fault...long story) nor the club's owner had much insurance or money so lawyers announced that they were going after SHELL OIL because they were allegedly a sponsor of the band's appearance.

She was friends with this woman for years and knew she had a big and increasingly aggressive and dangerous chimp, yet she chose to continue to visit. And this is the state’s fault how? Correction – how is this the taxpayers fault since they’re the ones who are going to pay.

This suit has a shot.

The State knew there was a dangerous animal (by statute) living on the property without a permit, which is required by state law.

I don't know.After the initial publicity (a month or more) it kind of disappeared from the radar.But given that Rhode Island is just about the most brain dead Marxist state of them all I'll bet it did.

OK. So what if I have a friend who is a hoarder like the ones you see on that TV show? The house is in shambles, dirty, rat and roach infested and cluttered to the extent that it’s a fire hazard. Oh and my friend also keeps about 50 feral cats in the house and hasn’t cleaned out her refrigerator in 10 years. My friend is of course in violation of multiple zoning and public health codes, (not to mention the complaints of her neighbors) and has no permit for having that many animals. But the authorities haven’t gotten around to condemning the house and evicting my friend quite yet. Perhaps numerous citations have been issued but it takes time for the authorities under the law to evict the occupant, condemn the house and demolish it.

In the meantime, I decide, of my own accord to visit my friend and stay in her house knowing full well how dangerous and disgusting it is and while I’m there, I’m bitten by a rabid cat, part of the roof collapses and I’m hit on the head by falling debris, then a fire breaks out and I nearly burn to death and I get salmonella from eating rotten food and a bacterial infection because of the filthy conditions.

Is this the State’s fault because they should have condemned the house and committed my friend to the loony bin days, weeks, or months earlier or somehow prevented me from going there; or is it my fault for putting myself in this situation?

Well, perhaps (just play along with me here :)) I was trapped for days under the roof debris and the 5 tons of newspapers and People magazines; weak, dizzy and suffering from smoke inhalation and still being cornered and terrorized by that rabid cat. So after the floor gave way and the refrigerator tipped over, the 5 year old bottle of cranberry juice and 10 year old Dannon yogurt that fell next to me was my only hope for survival.

Of course the neighbors dialed 9-11 right after the initial roof collapse and fire but they were way too busy to respond as they were serving a warrant to some crazy woman way across the county with a crazy monkey and some guy living in his mom’s basement full of death head moths and perhaps a rather big girl in a pit with an injured poodle named Precious.

Just saying. : ),

Oh and ETA, the fire didn’t spark for no reason as I failed to mention that my friend was a narcoleptic chain smoker – something else the state was responsible for protecting me from. /s :),

The friend died a year or so ago.
