The person is “called” a U.S. National in some cases or a U.S. Citizen in other cases. The basis upon which the person is a U.S. National or a U.S. Citizen when the parents were not U.S. Nationals or U.S. Citizens is described as native born citizenship arising from an application of the jus soli or law of the soil doctrine by an Acto of Congress in the form of U.S. statutory law.

Because citizenship derived from a statute can be eliminated in the future by the repeal of the statute, such citizenship is distinguishable from natural born citizenship resulting from natural law requiring no statute that could be repealed in the future.
