Use conspiracy to bring in the other co-defendants.

So ... it's beginning to look like the Alabama murder statutes do not apply to the late unlamented Jacquan's (whatever) accomplices in attempted robbery.
Too bad.
We'll see what the Alabama prosecutors think.

"I don't want it put out like he was a bad person or a mean person, because he wasn't," Latonya Walker, 38, said Tuesday. "This is not him, not who he was. Anybody that knew Ja'Quares knows that." Denial ain't just the name of a river in Egypt baby!

There has to be some football players out there named Download Jones and Hard Drive Washington. And a cheerleader named Propecia.

Those FB pics are what led me to the gang page URL. The reason I am pretty sure its them is the zip code mentioned (resolves to Fairfield, AL), and the "Field Boyz" in the FB pics (also same font & colors), and menjtion of the same middle school on page 3. Here is "little angel" Tez's self description:
"WAT UP BEBO DIS YA BOI TEZ REPPIN DAT FEILD 24/7 I LIKE TO GET HOEZ CHILL WIT MII HOMEBOIS GO GET DEM JS AND ON DA OHONE WIT FINE GURLS I ROCK JS AND FORCES I AM A REAL ASS NIGGA"
Quite a few colorful obits and shout outs to jailed companions on the page as well. (http://www.bebo.com/Members.jsp?MemberId=10581651932)

Wow, that's even younger than Trayvon. What's a body to do. A teenager can't even steal a car anymore without being shot for doing so.
Where's Al, Jesse, Malik and Barry on this one? How dare a white man shoot the armed teenager? It's racism I tell you. We've got to disarm all those white people so we can attack them at will. How are we to get our payday if they continue to shoot at us when we try to rob them?

Use conspiracy to bring in the other co-defendants.A prosecutor may be able to prove the elements of conspiracy to commit a lesser crime or crimes than murder, but the topic of our discussion was whether the other individuals in the car with Ja'Quares can be charged with murder.
My answer, based solely on a reading of the Alabama statute in question, is no. Other crimes? Very likely . . . assuming you can prove beyond a reasonable doubt that the others knew what Ja'Quares was going to do. But charging the others with the murder of Ja'Quares . . . no.
Alabama's statute appears to limit the felony murder rule to deaths caused by participants in the crime and doesn't extend to deaths caused by targeted victims, law enforcement, or bystanders, but I could be wrong.
If I weren't lazy today and if I wanted to spend the money on Lexis or Westlaw (or break my Justia protest), I'd look at judicial interpretation of the statute.

"Yes, its called Capital Murder when a person is killed during the commission of a felony of which you were a participant, even if the deceased is one of the partners in the felony............."Isn't 'capital murder' what one would be charged with if the crime was eligible for the death penalty, a/k/a capital punishment? If a state does not have the death penalty, it is my understanding that there would be no capital murder charges.

Ja'Quares approached a black Lexus SUV with a couple inside and ordered the driver out. The driver pulled a gun and shot Ja'Quares multiple timesSounds like civic improvement to me.

Here are a few more articles that add details:
"As she tries to deal with her son's death, Walker says she is left searching for answers. "So I don't know if they put my child up to do this. Did they threaten or scare him to do something like this?" she asked.
Walker says that even with a bandana on, it should have been obvious that Jaqures was just a child.
"I'm going to keep asking and I want to know what happened, the truth, however long it takes. I'm not giving up till I find out the truth," Walker said.
[where have we that before...]LINK
Disturbing photos surface of 13-year-old robbery suspect
LINK "Police says Jaqures Walker had just approached a car and told the male driver to "give it up," when the man pulled a gun, shot and killed Walker. ....Also, one witness told police that two men wearing blue bandanas were watching the robbery and shooting go down. That's another suggestion it could be gang related.
So is there a gang problem in Birmingham? Officer Jamarah Nevitt says there is a gang issue in the city, but a gang problem, he says, is questionable"

I once worked with a woman with one of “those” names. She was bright, professional and well-educated.
She used her first initial and middle name, which was Diane.
The weird name thing was popular when she was born, and her mom did it because other young moms in their neighborhood were doing it. Diane hated it but didn’t want to disrespect her parents by changing it.
