John Roberts, evil genius

Chief Justice John G. Roberts is an evil genius. The ruling to uphold the Affordable Care Act is, on its face, a win for President Obama both because the media are saying it is and because it is the signature piece of legislation of his first term. But it may turn out to be a pyrrhic victory, as Roberts accomplished numerous, subtle victories for conservative Republicans.

Well on the one hand, federal powers under the Commerce Clause have been limited.

On the other hand, federal powers under the 16th Amendment have been expanded to make up the difference with plenty of room to spare.

I don’t see how this is a win for anyone but the fascist left. They’ll just stop using the Commerce Clause to justify their agenda and use the IRS instead.

I’m certainly not a constitutional law scholar - - as the MSM likes to refer to Zer0, who was a part time law lecturer for a coupl’a semesters whilst pimping other people’s money in the hood, but:

I think that Roberts has done a masterful job of taking SCOTUS out of the political world, and placing Obamacare back into the legistative play during an election year.
And by calling it a tax, undercutting all the Zer0 BS; and with the ability for the soverign states to opt out of this disaster of a law, he has set the stage for the legislative branch to fully relook at the RAT law cram-down.

He deserves our praise!

Listening to the Lars Larson show.

It is being pointed out on the show that if Obamacare is a tax, and tax bills have to start in the House, how did this bill start in the Senate and given the nod by SCOTUS?

I missed part of the discussion on the show.

Is there something I'm missing besides my tagline?

IIRC, ObamaCareTax wasn't challenged on the point of having originated in the Senate. I'd guess that could, and will, be grounds for one of the multiple other challenges that are going to be launched as a result of this decision.

I can't argue with Roberts' rationale on that key issue. If it's a bad law, the solution is to overturn it rather than render legal opinions about it.

We had a similar situation here in New Jersey a while back when the Democrats pulled a switch after the Democratic primary and replaced Bob Torricelli on the ballot in a U.S. Senate election with Robert Menendez once it became clear that Torricelli would lose. There were lawsuits filed in the case, and I believe they found their way all the way up to the U.S. Supreme Court.

The court's decision was disappointing, but correct. The court basically said: "This is idiocy by any measure, but it doesn't have any place in a Federal courthouse. If the people of New Jersey allow their sh!t-hole state to be run that way, then so be it."

I’m not sure Roberts was thinking that far ahead. His decision was cowardly, it resolved nothing and it created a tax out of whole cloth and the dems don’t have to vote on anything.

They’re toast, Obama is done and the country will kick them out en mass but this decision is cowardly.

Already done -- anybody who paid federal taxes in 2009 has made their lawfully mandated contribution.

Not to worry, ObamaCare has a provision to take care of those folks.

The Chicago virus now infects our founding document for constitutional order. We saw this in the AZ case. This is a trajectory for the destruction of our nation which I think is what many who voted for Obama wanted anyway.

On this we agree. In no way does Roberts convoluted ruling do that. It just makes him look stupid. Now a “penalty” is called a “tax.”

Roberts is just interested in “making his mark.” Well, he did. And many of us have marked him as a dipstick!

Interesting point is that your boy Romney has held up Roberts as the kind of jurist he would appoint. One more reason NOT to vote for Romney.

What is the fastest way to create millions of Republican voters? Tax the living daylights out of them.

Give the Democrats a few years. They'll create Republican voters because they can't help themselves.
