Penn State trustees file appeal

A Penn State board of trustee member filed an appeal Monday afternoon with the NCAA over sanctions levied against the university after the Jerry Sandusky child sex-abuse scandal.

Three other trustees joined the appeal, which states that the consent decree university president Rodney Erickson signed with the NCAA agreeing to the sanctions is "null and void" because Erickson "lacked the legal authority" to enter into such an agreement without the board's approval.

Trustees and a person with first-hand knowledge of the discussions said the move is a precursor to a federal lawsuit asking a judge to invalidate the sanctions, because trustees expect the NCAA to reject the appeal.

The appeal, sent to the NCAA from attorneys hired by Ryan J. McCombie, a retired Navy SEAL who joined the 32-member board in June, also challenges the NCAA on the following fronts:

• The NCAA did not give Penn State trustees and the university due process when it did not follow its usual investigation and enforcement procedures.

• The consent decree is fundamentally unfair because it relies on the Freeh report, which "contains findings and conclusions not that are contrary to the evidence presented ..."

• The sanctions are "excessive and unreasonable" because they inflict "permanent damage to an entire generation of student-athletes and coaches who were innocent of any wrongdoing during their time on campus ..."

Erickson signed the consent decree late last month with the NCAA after consulting with board chairwoman Karen Peetz and university counsel, but he did not bring the decree to the full board for review or a vote.

The package of sanctions included a $60 million fine, a four-year bowl ban, scholarship losses and the vacating of wins from 1998 through 2011.

In other words....Penn State University will lose in court....but Joe Paterno (his estate) will more than likely prevail in their individual lawsuit (mainly re-instating JoePa’s wins)

Joe got many of those wins because he didn't turn Sandusky in. How does anyone figure what Joe's record ought to be had he done the right thing at the beginning?

You got it right.

Also, the NCAA has egg on its face from letting PSU skate until now, especially given what they've done to other programs.

I'll predict the suit will be dropped or dismissed after the NCAA and PSU admins clue in the out-of-the-loop trustees filing suit.

When alerted in 2001 of a potential incident, he had the witness meet with the campus authorities responsible for Jerry Sandusky.

jb729...I believe most of the evidence went down the drain in the Men’s locker-room.

JoePa looked the other way and let Sandusky remain on campus for years.

There is a special place in Hell for those at PSU that looked the other way.

The NCAA regulates competitive advantage. Punishing a university for an ex-faculty members crimes is beyond anything in their by-laws

There’s thousands of incidents involving various schools having faculty members committing crimes. Where are these schools punishments?

If you cite the alledged coverup, please tell me which page of the Louis Fraud report contains the evidence? Thanks in advance.

Some photoshopped picture of Joe’s statue really doesn’t hurt my feelings or change my position. What I would like you to do is point to the irrefutable evidence in the Freeh report that shows Joe Paterno orchestrated a coverup. If you can do that, I’ll join you in calling Joe Paterno a scumbag that is burning in hell.

As far as letting Sandusky remain on campus for years, perhaps you should educate yourself with professor emeritus and who is responsible for adminstering it. Iron-clad teachers union contracts are what allowed Sandusky on campus for years, not the grand mastermind poohbah 80 year old Joe Paterno who couldn’t get through a press conference without incoherent babbling.

If the “findings” are what Louis Freeh found, then YES! I definently want the findings spread across the nation! He found nothing!

Good move. The sanctions were pathetically knee-jerk / lynch mob. What was the point of taking away all the football players’ wins since 1998? They didn’t cheat, and they certainly had nothing to do with the rest of the homosexual pedophile scandal.

The sanctions should have amounted to money. Lots and lots of money. I hope the players get their wins back and the school gets 100X the fine amount instead. Then, completely shut down the football program for 10 years (and thereby starve every other sport the school sponsors).

Money talks.

Welcome to Free Republic, and thanks for your reasoned posts. I only hope some of the big-mouths around here some day have somebody point at them and allege that they are homosexual pedophiles, since they think that's such an easy, happy-go-lucky thing to do.

The fact is, McQueary never told Paterno that he witnessed an actual rape. But the old man was creeped out enough by the possibility that his former assistant coach may have done something "inapproriate" that he did indeed send the matter up the chain of command to people who were supposed to look into it further. Those people failed to do so.

It's scary, all the big-mouth nobodies who love to crucify Paterno because they apparently think it's no big deal to point at a man and accuse him of being a homosexual pedophile. They never consider the ramifications of a mistake. (Obviously, Sandusky actually did turn out to be a homosexual pedophile, we now know.) But imagine if an accusation against a man turned out to be totally false, the result of a complete misunderstanding or even malice? What would they say then? "Oops. Sorry about that, heh heh."?

As far as I'm concerned, you don't make that kind of accusation against a man unless you see it with your own two eyeballs. Paterno did not. McQueary (apparently) did, although even that is by no means clear. (Anyway, I still don't get how McQueary, who was at the time in 2002 a 28-year-old employee of the university, has skated on this thing so far?)

All those years went by and no victim (or victim's guardians) ever came forward (aside from the woman in 1998 whose son came home with a wet head)? How is that possible? Like Paterno said, Sandusky had everybody fooled. Homosexual pedophiles are sneaky that way, by nature. I don't know how the cops investigate accusations of child molestation, but I suspect they do it very quietly and carefully. Actual victims coming forward would certainly propel the case.

Anyway, Sandusky didn't get away with decades of homosexual pedophile rape because Joe Paterno and a couple of other university officials looked the other way - - Sandusky got away with homosexual pedophile rape for decades because a hundred people, including his family and friends, his Second Mile associates, university donors and benefactors, and reporters looked the other way. Hell, even The Creamery made fun of Sandusky's affection for young boys with their "Sandusky Blitz" ice cream dish.

But no - - small people have more fun laying everything at the feet of Paterno.

What don’t I see?

When you drain $60 million out of a program, cuts have to be made in that program -- taking away salaries for trainers, coaches, managers, amenities, etc
