Harrison father shoots a man he found under his child's bed(AR)

Police say no charges will be filed against an Arkansas man who they say shot someone who tried to break into his home.

officers say a man who lives on Fick street came home today to find Ryan Gingerich hiding under his child's bed. Wtnesses say Ginerich had a wrecking bar and a screwdriver in his hands. The homeowner ran to get a gun and Gingerich jumped out a window. Police say Ginerich didn't stop when the homeowner told him to, so he was shot.

Agreed about the spell checker, but I’m thrilled the home owner won’t be charged! People are fed up with crime, which will be reduced with a Romney administration, no doubt.

I find this story interesting. Arkansas does not have a “Castle Doctrine”. If the perp was fleeing the scene he was no longer a threat. There has to be more to this story.

I think that it was sensible law enforcement, something that is as extinct as the dodo bird in the cities. The man found a guy under his child’s bed and decided to shoot the criminal, no matter how far he ran away.

The civil liberty lawyers will be contacting the perp and telling him that he can sue the homeowner for shooting him. This case isn’t over.

Actually, according to the story, he had climbed out from under the bed, jumped out the window fleeing, and was running away. That’s when Dad shot him.

That's often said, but it's not always true, is it? Criminals come back, sometimes for revenge. I've seen it in news items, but don't know how common it is. From a safety point of view, when you're talking about home invasion, I'd think the threshold for "no longer a threat" is when the criminal is no longer breathing.

Plus, although there could be hundreds of ‘possibilities’, perhaps it wasn’t the first time or the father recognized the runner.
For real safety sake, it should be the guys OBIT.

I definitely agree with your ‘no longer a threat’ analysis but we seem to be in the minority.

From the sounds of some of these posters one would be led to believe that after serving the idiot cookies and milk, the homeowner should have given the guy a ride home.

Also, if the HO had a picture of a ‘long gun’ over his door with the inscription “WE DON’T DIAL 9/11” he is justified in dispatching an unwanted guest and assisting his assuming of room temperature.
