White House Endorses Internet Sales Tax ["Not One Dime" of your taxes will go up?]

The White House today endorsed the Marketplace Fairness Act, which would be a tax hike for purchases made over the Internet. The White House claims the tax would "level playing field for local retailers."

"The Administration strongly supports S. 743, which will level the playing field for local small business retailers that are in competition every day with large out-of-state online companies," reads the Obama administration's statement on the policy.

They're not in competition. They're continuing to further outlaw competition, as they already have with so many other regulations against competition. Shut 'em down! Go Galt!

I’m ambivalent.
.
One the one hand, I detest new taxes and infringements upon freedom.
.
On the other hand, I stand to make plenty of money bringing client’s shopping carts into compliance.

Same with ADA and website accessibility.

The playing field is level. Local retailers must charge sales tax and online vendors must ship each order individually and charge for that.

How ‘bout we eliminate state sales taxes in toto, bringing them in line with out of state internet sales?

If you live in a state with sales tax, you already owe taxes on all the purchases you make on the internet. Each year, you are required by your state to report all of your untaxes internet purchases, and to re-imburse the state for the sales tax, at the same rate as for items purchased locally.

In many states, it is built into your income tax forms. A line on the Virginia form, for example, asks specifically for your “use tax” amount (which is the name Virginia gives for sales tax you have to pay). When you sign your Virginia income tax form, you are swearing by your good name, under penalty of a felony perjury charge, that you have accurately reported the taxes you owe on internet purchases.

The federal law will move the burden of collecting and remitting this tax from the customers to the stores they purchase from. This might not be nice for those businesses, but it does not increase your legal taxes owed by a single dime.

Now, it is true that, since you have to give your word about what you bought, it is a lot easier to commit a felony under the current regime. So for those who think it is their patriotic duty to cheat on their taxes and commit felony perjury, this law should be opposed.

If you are an honest person who has faithfully kept track of their purchases on the internet each year, adding up the amounts and reporting them as required by law, you might actually appreciate first that you don’t have to do the bookkeeping anymore, and also that so many other people who are less honest than you are getting away with cheating, thus driving up your taxes.

How do you think the local stores get the product they sell locally? Do you think it magically appears on the shelves?

A local shop has to pay the same shipping costs to have trucks bring the product. They have to pay property tax on their building, or pay lease charges. They pay for heating/cooling, for security, for someone to stock the shelves, for cashiers to interact with customers and sell the products. They have to keep the stores clean, they need to maintain parking lots.

It is much more expensive to operate a local business, than it is to operate an internet shop. The shipping costs are at best a small inconvenience made up for by all the money saved by not operating an actual store in a high-priced retail area.

And while the online vendors don't have collect the sale tax, the purchasers still have to pay the tax, just at the end of the year, or quarterly, depending on their state laws. The only thing the online purchase does it make it easier to cheat on taxes -- it doesn't change the legal requirement to pay the taxes.

You might as well argue that if the police are on strike, you are then allowed to rob your bank, since you won't get caught.

If you like that idea, you should petition your state representatives. Maybe you would prefer higher property taxes, or a larger income tax which the liberals can make “progressive” so that rich people pay a lot more than the rest of us.

Or maybe you think government shouldn’t exist at all, and doesn’t need any money.

I was just about to make the same point. Essentially, the bill will require the retailer to collect the tax you were obligated to pay and forward it to the state you owed it to. The necessity arises from the fact that the vast majority of those who were obligated to pay the tax weren’t paying it.

In the last two years, California gave up trying to encourage every citizen to track and pay use tax, and just developed a formula based on gross income. The net effect of that is that the majority of those who were actually complying with the law have seen significant reductions in their use tax payments.
