Here's some simple "arithmetic." Not only is Congress responsible for legislating UCMJ with respect to its Section 8, Article I-limited powers evidenced by the link below, but also consider the following.

The Founding States made the very first numbered clauses in the Constitution, Sections 1-3 of Article I, to clarify that all legislative powers of the federal government are vested in the elected members of Congress. So if there are federal military regulations which prohibit proselytization then I think that both Congress and military brass have some explaining to do concerning why they are threatening the constitutionally protected rights of members of the military, especially since military leaders as well as federal lawmakers have sworn to protect and defend the Constitution.
