Day 16 (Week #4) Zimmerman Trial Witness Discussion Thread
The Conservative Treehouse ^ | July 1, 2013 | Sundance

Posted on 07/01/2013 5:17:35 AM PDT by Uncle Chip

Today, July 1st, is DAY #16 (of 4th week) State of Florida V. George Zimmerman case.

Last week the prosecution feebly presented the first series of witnesses against George Zimmerman. However, as most observers would note, the witnesses called by the state have so far been more beneficial for the Zimmerman Self-Defense position.

You are right about that . It’s exactly what my wife keeps saying to me.. “GZ started this when he got out of the truck. “. Therefore he deserves some of the responsibility. My wife would not support a murder conviction, but I suspect she would have agreed to a lesser charge.

Damn illogical women! I hope my marriage survives this trial. /s

Detective in Zimmerman case said he was pressured to file charges

The lead Sanford Police investigator who sought manslaughter charges against George Zimmerman told the FBI that a sergeant and two other officers tried to pressure him into making an arrest in the controversial case — even though he didn’t think there was enough evidence.

Sanford Police Officer Chris Serino first made headlines when evidence released in the case showed he sought manslaughter charges against Zimmerman even while his chief publicly said there was no probable cause to arrest him. But a document released late Thursday casts doubt on Serino’s prior sworn affidavit seeking criminal charges, and raises questions about the credibility of the star law-enforcement witness in the murder case against Zimmerman for the shooting death of a black teenager, Miami Gardens high school junior Trayvon Martin..

Telling the FBI that he was concerned that people inside the police department were leaking information, Serino cited Sgt. Arthur Barnes, officers Rebecca Villalona and Trekelle Perkins “as all pressuring him to file charges against Zimmerman after the incident,” an FBI report said. “Serino did not believe he had enough evidence at the time to file charges.”

The summary of Serino’s statement does not mention the race of the officers who allegedly pressured him, but sources told The Miami Herald that Barnes and Perkins are black, and Villalona is married to an African-American man. All three, the source said, had been called in by their supervisor and questioned about leaking information in the case.

Uh, those lawyers aren’t getting paid to represent GZ. It’s their opinion. If they were getting paid, they’d sing a different tune. Why didn’t St Skittles call the police? Why didn’t St Skittles run away from a fight? It was just as much responsibility for the thug to avoid the fight. All your spouting off about getting out of the vehicle is BS. Unless GZ is waving a gun in the car, or after getting out of the car waving a gun at St Skittles, your line of thought is irrelevant to the claim of self defense. GZ has the legal right to exit his vehicle. He’s committed no crime.

“Our position has always been that there’s something going on in the Sanford Police Department,” said Benjamin Crump, an attorney for Trayvon’s family. “All of this is window dressing. What’s important is George Zimmerman’s statements, which are inconsistent and factually impossible.”

Serino, a 15-year veteran of the department who was a major-crimes investigator, was demoted last month to overnight patrol. Tapes of his interviews with Zimmerman show him poking holes in the former neighborhood watch volunteer’s account of what happened the night he killed Trayvon. Serino told the FBI that Zimmerman had a “little hero complex” and sounded “scripted.” However, he said he believed Zimmerman targeted Trayvon because of his attire, the circumstances and recent burglaries in the area, not the color of the teen’s skin.

In his FBI interview, Serino accused Sgt. Barnes of being “friendly” with Tracy Martin, Trayvon’s father. He said Tracy Martin at first understood why no charges were filed, but later changed coursse and accused Zimmerman of racial profiling.

Crump denied that Tracy Martin ever changed postures. Martin, he said, sought legal counsel the very day Serino told him no charges would be filed.

Records released Thursday show that Sgt. Barnes, a 25-year veteran of the department, told the FBI that he believed the black community would be “in an uproar” if Zimmerman was not charged. “The community will be satisfied if an arrest takes place,” the FBI quoted him saying. Barnes “felt the shooting was not racially motivated, but it was a man shooting an unarmed kid.”

That's the big problem with women...and I am one...they get stuck on one item and ignore the big picture.

He was neighborhood watch. It's what they do. And he was trying to furnish info which he couldn't do from his truck so he wouldn't be wasting the cops time.

Tray played cat and mouse in order to confront GZ instead of going home.

...public means “domesticated” streets which allows police to enforce traffic infractions.

Not sure what domesticated means, but it is my understanding and experience in VA back in the day as a cop that police can enforce state laws on any highway (meaning neighborhood roads too) which are paid for/maintained by the gov - local/state/fed. The only exceptions were, if I recall (and I am getting long in the tooth) reckless driving and DWI/DUI.

We had many private communities that had to put a letter on file with the local court authorizing PD to enforce traffic code on their private roadways.

Not trying to pound my fist and say this is gospel....just what I was raised on...someone else might have a different answer from another state.

One thing that some folks can’t comprehend or get through their skulls is....a Neighborhood Watch job is different for different types of neighborhoods. My ex was temporarily our ‘watchperson’ in our neighborhood years back in Houston. But all he did was patrol up and down the streets in his truck, looking for suspicious activity.

IOW, in a non-gated neighborhood, the watchperson could and should stay in their truck/auto most, if not all, of the time...since that is the only thing they can do is drive up and down the streets.

In a gated condo community, however, the job is or can be much more pro-active as far as the necessity of getting out of your vehicle and observing in and around the housing units. Zimmerman was just doing the job thoroughly. Who knew he would encounter a teenage thug with a chip on his shoulder and already a record of getting into trouble and drugs.

For starters, liberals tend to think man is basically good and just needs to be given the opportunity to prove it. Meanwhile, conservatives tend to see man as basically evil (all have sinned and fall short of the glory of God) and must be challenged to do the right thing.

Liberals think that liberals are basically good and just need a chance to prove it, but that conservatives are basically evil. As for myself, I subscribe to the idea that people are not inherently good nor evil so much as they are human. I think most people aspire to be good, but some of them--especially those infested by Liberal Mind Fog--are severely confused as to what that means, and many of them can be readily tempted into doing things they know are wrong. Personally, I regard sinfulness and evil as being two very different concepts, with sinfulness being indifference to God's will, and evil being deliberately contrary to it. Most people are far more sinful than they are evil, but there are some definite exceptions.

What did everyone think of the cop saying from the stand, in the final minutes of the trial today, that Zimmerman said “Thank God” when told (falsely) that someone had recorded the entire event?

Cops are allowed to lie. I have been on the receiving end, when I held a government position, and a crime was being investigated in my department. I was LIED to by the cops, who told me that others had already said I was in on an illegal scheme. I said, “I don’t care who told you, they are liars, and I will go to jail proudly before I ever admit to anything I did not do.” The interrogators looked at each other and let me go.

In this case? The cop was trying to get Zimmerman to crack. Instead, Zimmerman KNEW he was in the right, and said, “thank God” when told of a video which does not exist.

And, his address.

I think he gave a witness address as well; maybe the one who dialed 911.

Zimmerman will probably need to go into witness relocation anyway. I cringed when I heard the SSN put out there. I'm not even sure LIFELOCK can help him now. Maybe they can assign one LIFELOCK employee to handle just his case!

Can he get a new SSN?

Didn't Obama get his SSN replaced a couple of times? (*snicker*)

jacquej, and we women tend to see things based on our own personal experiences in life, often our emotions, and eventually critical thinking. (If we are sensible)

My opinion?

Thank God that there are men who overcome their personal fears to protect us from thugs, rapists, vandals, burglars, and marauding hordes. We just don’t have the upper body strength to do it.

But, I understand our thighs are stronger than theirs. Maybe we need to figure out ways to use these against them. (a double-entendre, actually)

I can’t reply to every single person who believes that interrogation tape is no big deal

so I will say this in this post.

I bet MOST OF YOU ..if NOT ALL OF YOU...don’t even know what is required to claim self defense in Florida.

And YES, WHY he got out of the car is important and he has told CONFLICTING STORIES ABOUT IT

There is a recent Florida court case that you need to look at if you believe that WHY he got out of that car is not important.

That tape is a problem.

Hopefully O’Mara can overcome it.

PS maybe some of you should listen to what he said about WHY he would not go chasing after somone even though he is on Neighborhood watch. Because he has a wife.

I think the simple synopsis is...
1. Bored; troubled teen Trayvon went to the store to get ingredients for an urban concoction to get high....”Purple Drank”, or some other variation.

2. Dee Dee/Rachel/Diamond was one of his Phone/FB chat buddies whom he conversed with frequently. They were not lovers.

3. On the way home from the store, TM appears to deviate from the direct path to his Dad’s home...acting suspiciously according to GZ. It is pouring rain at the time. As an aside, There are prior allegations that TM was in possession of/ suspended from school for stolen jewelry/property from residential break-ins and burglary tools.

4. GZ (Community Watch Captain) sees a stranger in the neighborhood acting suspiciously. It is Trayvon Martin. GZ calls the cops and tried to keep TM in sight until cops arrive...GZ isn’t confrontational, but I’m sure he is making it clear to TM that he is being watched.

5. TM told Dee Dee about GZ watching him
6. Dee Dee egged Trayvon on by playing to his gangsta mindset, and jokingly dared him to confront GZ because he might be “a rapist”...done purely to get a rise out of him and challenge his manhood....to provoke him to react.

7. TM sees a smaller “cracker” who he can beat down...and enhance his rep. I’m sure pics would have been posted on his FB account.

8. TM is a little jacked up and looking to score thug points with Dee Dee and his Facebook homies.

9.TM approaches GZ and proceeds to kick the snot out of him. I can almost guarantee GZ was stalling as much as he could, knowing the cops were on the way....praying they get there soon.

10. GZ was packing heat in a mixed neighborhood where violence and crime are not uncommon....smart on his part

11. During the scuffle; and with Trayvon saying, “You’re gonna die tonight MF” , TM sees GZ’s gun and reaches for it.

12. During the struggle, the gun goes off and someone dies.

13. TM lost....he made a fatal error in judgment. TM calculated that a smaller, weaker person would be easy pickin’s for a beat down. He forgot one major reality.... a gun is the ultimate equalizer....Our founders sure were smart.

Remember, GZ would probably be dead had he not been carrying....all because a young, angry, hormone-filled, racist thug teen was bored, high and challenged.....or dared. Had GZ not been carrying a gun, his head ultimately would have been an oblong, broken jar once holding his brains.

. My personal belief is that Dee Dee/Rachel hardly knew TM. She chatted with him ...along with lots of other people….in 3-way phone calls. He was just somewhere in the mix of her assorted chat buddies.....nothing special.

Rachel didn’t want any part of the funeral or trial because TM is dead because of her probable encouragement to confront the “creepy assed cracker (rapist)”, and play the “Knock-out game.” That night was a stupid, violent game that got way out of hand….played many times before without someone dying.

It’s not logical that minority advocate/minority citizen Zimmerman stalked/chased/profiled and confronted a larger, minority citizen and premeditatedly murdered him because of his skin color? ....after calling the cops and expecting them to arrive at any second? …didn’t happen.

I’m biting my tongue to opine as to the motivation of the plaintiff’s, and the “State”

You do the math....

I agree with you.

I think I finally got the idea across to her with the map. She thinks TM was scared and had a right to initiate a fight. I showed her the map. Maybe, at first, TM was scared.. If he was, he made it home and Could have stayed ther... End of story. But at some point, scared TM turned into Bad Ass TM, and THAT is when the trouble started.... Not when GZ got out of his truck.

That message seemed to resonate with her.

Martin’s character and past misdeeds and type of person are REALLY relevant here BUT can’t be told to the jury.

Hopefully , they already know about it and can understand that there is reasonable doubt that GZ did not provoke the confrontation.

If the jury believes that Zimmerman provoked it he is in trouble.
