Renisha McBride's Alleged Shooter to Be Charged With Murder

The man accused of shooting 19-year-old Renisha McBride in the face outside his suburban Detroit home will be charged with second degree murder, manslaughter and possession of a firearm during a commission of a felony, the prosecutor said today.

McBride was believed to be seeking help after being involved in a car accident.

Wayne County Prosecutor Kym Worthy identified the alleged shooter as Theodore Paul Wafer, 54, of Dearborn Heights.

"We do not believe he acted in lawful self defense," Worthy said at the news conference.

Worthy said that Wafer is not yet in custody and will be turning himself today. She said he has been cooperative with police and is expected to be arraigned later today.

Worthy said that witnesses reported that McBride was "bloodied, disoriented and appeared to be confused" after the accident in the early hours of Nov. 2 and left the scene on foot.

"Hours later, her lifeless body was found by the police near the porch" of the suspect, Worthy said. "[She was] found with a very large gunshot wound to her face."

Evidence suggested that she knocked on Wafer's locked screen door and that he opened his front door and was inside the house when he fired a shot through the open door, but a still closed and locked screen door, the prosecutor said.

There was no evidence of forced entry to the home, Worthy said.....

Worthy said her office "obviously" did not feel that the defendant acted in lawful self defense.

McBride's toxicology report released by the Wayne County Medical Examiner's Office on Thursday indicated that she had a 0.218 blood alcohol level, which is more than twice the 0.08 legal limit for driving in Michigan.

The report also indicated presence of marijuana in her system and the recommendation for a "confirmatory recheck."

The prosecutor said that in Michigan someone who claims lawful self defense must have "honest and reasonable belief of imminent death or imminent great bodily harm" to themselves or another person and that the use of force must be necessary to prevent that.

I read something here yesterday saying that she had a very high blood alcohol level, and that she was shouting and screaming at the door.

I think a lawyer could argue that it certainly looked like an attempted home break-in. A mistake, but maybe an honest mistake.

Well they did charge him with everything except spitting on the sidewalk. Most of those charges are BS.

That’s what prosecutors do. Throw crimes against humanity at the defendant in hope of getting him to plead no contest to speeding.

I'm not really sure how if she was on his porch and there is no evidence she tried to gain access to the house. He might have a better chance of arguing imminent danger if she was drunk and ranting, but it's his word alone on that and no evidence of a weapon or an attack.

Her family is deeply disappointed. They wanted the DA to convict the homeowner on the spot without a trial. There must be something about Renisha they don’t want coming out in court.

Thats why along with my home defense I have security cameras that run 24-7. If this had happened to me at least I would have had video evedence of her behavior. Something like that might make the difference in court.........maybe.

I read in some story that she was shot in the face with a shot gun - but at a distance.

I think the whole case will revolve around distance.

The terms On the porch & at the door give the impression of pretty close.

Sounds more like he was too ready to shoot.a GUN IS NOT THE ANSWER TO EVERY PROBLEM.Based only on what has been released so far, I would have to convict on voluntary manslaughter charge.Police aren’t the only ones who use excessive force.

He could have closed the door and called police and life squad.

The homeowner told police he thought McBride was breaking in; he also said his shotgun went off by accident.

I’ve wondered what’s the law if someone is trying to kick your door in?

Judging from other cases probably justifiable homicide but only if they succeed in kicking the door open. Shooting someone through a closed door is the Biden method and is likely to get you convicted pretty much anywhere.

He should plead guilty to negligent homicide and be out of jail in less than a year if he goes at all.

Black family already has a lawyer (Benjamin Crump style), black prosecutor making absurd charges, and an 80% black town for a jury pool. Does anyone seriously believe a white man is going to get a fair trial in Detroit?

The law says you can use force if someone is breaking into your house. Is there any evidence she was trying to kick his door in?
