It makes me sad that people will accept the practice. The people demand safety first and freedom second.

Yes MADD has turned DUI into an industry designed to build jails, fund courthouses, make attornes rich. It’s a big racket.

Where do you think that counties get the labor to clean up roadside garbage and whack the weeds along the highways every weekend?

It's called being sentenced to community service.

My son just went through a dwi. $1400 fine, $750 dmv fee, $75 a month for breathalyzer. It’s big business round these parts. They don’t care about anything but the money.

unfortunately the state will tell you driving is not a right but a privileged and by signing for your license you state you accept that fact and will comply...

not saying it's right, just saying

LOL>> I see by your handle you will appreciate this. I had a friend who is dead now that was a Huey pilot in VN. Flew in the $hit countless times. He came back and became a private pilot for a utility. Once his co-pilot crashed the ship and in the inquiry it was brought up that my friend was seen drinking right before the flight. He said sure he was. That he was technically drunk every minute he was in a helo and could still outfly most sober pilots. The co-pilot had tested cold sober. My friend got fired and started his own business but had his ticket jerked by the FAA. He continued to fly in Alaska for years drunk and never had and incident. I flew with him many times. Best pilot I have ever known.

My blood boils when the sargent starts lecturing the driver, and characterizes the exercise of rights as being ‘crap.’ I also noted that the first officer failed to identify himself when asked, and instead called for the sargent.

An interesting principle is that assertion of a 5th Amendment right cannot be used as a basis for probable cause. The Cops here don’t like that.

The only way this driver got away with it is that the cops in this example have a conscience. What he did in many cases could get him beaten or jailed in America, this land of liberty and freedom.

It's a good point. Thanks for bringing it up.

Wonder what it will stir up in the way of discussion around here.

I'm of the opinion that roads aren't private property and cars are not homes, but I really haven't worked it out.

Clearly one of the Police Officers easily lied (routine policy) and stated that he smelled alcohol in the car.

Alcohol is odorless.

Yes, the war on drunk driving has helped the left transfer power to the state that was never intended.

And don't forget the "War on Drugs". Try explaining on FR how that has led to the police state and stand back. There are a lot of people who think I'm advocating drunk driving and drug-use when I try to point out that more severe laws are just hurting the rest of us.

personally i think it's wrong to stop someone without probable and reasonable cause, it just is not American, it's simply "Show Me Your Papers" if you will, but it is the law and if you refuse you WILL lose your license...

if you consent and are arrested anyway, at least your lawyer has something to fight be it how the test was administered to the maintenance of the machine and it records etc

Through painful personal experience I've found the Fourth Amendment doesn't include one’s car. Driving is a privilege states grant and it can be revoked. It isn't a right.

You can get a DUI for being asleep in your PARKED car with the keys in the ignition. Even though you may not have actually driven drunk, they’ll bust you anyway. It is a racket.

Your car cannot be searched without probable cause. Neither can your person.

DUI checkpoints get around probable cause requirements by stopping every car.

Again I don’t care what 9 political appointees in robes say. I can read. This is no longer the middle ages where only the priests speak and read latin.

But the only way to fight stuff like this ultimately is with the 2nd Amendment under advisement from the founding fathers. but that route is a last resort route and fraught with danger with what could emerge. As long as political options exist we can fight checkpoints at the ballot box. But too many people, even people here at FreeRepublic want checkpoints. People want checkpoints because they wish to live under the illusion of safety. The dirty little secret is that in this life, and on this planet, safety does not exist. Risk can only be managed.
