MARK LEVIN: Republicans should pass resolution declaring NULL AND VOID

Mark Levin says he thought long and hard about what the House of Representatives can do, given that they won’t use the power of the purse to reign in this president, and has come up with a solution. He says they should pass a resolution declaring null and void all presidential acts that are unconstitutional.

Hey lays it out below:

There’s something the House of Representatives actually can do. …Congress is a co-equal branch of the federal government and the House of Representatives is a co-equal branch of the United States Senate. The House of Representatives should pass a resolution. If the president of the United States can unconstitutionally assert powers he is not granted under the Constitution and do so repeatedly and brazenly, and send his staff out to the mainstream media outlets to do the same thing, then one body of our government must act.

I wish that Dr. Levin would run for President.

He would straighten this country out in the same manner that President Reagan did.

Resolution aren’t legislation and do not have the power of law. Can it lay the ground work for impeachment, a little I suppose, but who imagines our Senate, even with a new composition, will ever show guts to convict.

At least with Mark’s suggestion, should it prevail, the position of the House will be made apparent in any court action that might transpire.

Okay, sounds good, but who exactly determines the criteria for the acts being "unconstitutional"?

Is it Congress? (which means the RATs in the Senate could retroactively claim every executive order that George W. Bush and Ronald Reagan ever declared was "unconstitutional" and now nullified immediately.)

Is it SCOTUS? (which would make this proposal unnecessary, as they have already had the power to nullify things they declare "unconstitutional" since Marbury vs. Madison.)

Is it Mark Levin himself? (most likely, but good luck arguing that Congress should nullify laws based on what Mark Levin said about them on his talk show)

Mark is for nullification by the congress but not the states? The states created this government and should nullify. It is the states job, and they can do that by badgering their elected congressman and senators to do it. If not, then it is left to the states.

I’m going to rock the boat with this comment. Personally, I am not on the “Ted Cruz for POTUS” bandwagon.

Don’t get me wrong, I LOVE and RESPECT Senator Cruz more than you could know. He is a true Patriot, Brilliant Constitutional Lawyers and a fine family man.

That said, he has only been in the Senate for 1 year. Prior to that, he served as Solicitor General for the State of Texas for 5 years.

He has never run or managed a business. He has absolutely no Foreign policy experience at all. His forte’ is the Constitution. Period.

I do not believe that he is ready or experienced enough to step into the Oval Office at this point in time.

I do believe that his intellect, personality and understanding of our Constitution makes him extremely qualified for the positions of either Senate Majority Leader or Chief Justice of the Supreme Court.

PS: I do have a degree of “insider” familiarity with Senator Cruz, not that this means anything at all.

Making yourself intimately familiar with our Constitution (Article 1) would answer that question for you. get a copy and read it. It’s all lined out in very plain English.

I agree. He is not the ideal candidate. Scott Walker is. Although Cruz has as much experience as O.

It would be a swell gesture but whether Congress can combat executive orders or not the House can’t do it by itself and any act of Congress could be vetoed anyway.

I would like to see clear limits drawn for executive power but don’t hold your breath that it will ever happen.

Which entirely supports my position.

Not that Ted Cruz has the same Character Shortcomings that Obama has. Not in a Million years.

The next POTUS is going to have one hell of a mess dropped into their lap and must be prepared to deal with that.

Retired Marine General James Mattis comes to mind.

This country is going to need someone that can face down our emboldened and enabled enemies....both Foreign as well as Domestic.
