Republicans: Obama violating Constitution, but little can be done about it
foxnews.com ^ | February 16, 2014

Washington Republicans on Sunday restated their argument that President Obama has violated the Constitution by using executive orders to alter the Affordable Care Act, but acknowledged they likely have no recourse or ability to stop another incident.

Sen. Mike Lee, R-Utah, told “Fox News Sunday” that congressional Republicans think the president abused the government’s separation of powers by using the executive orders to sidestep Congress and delay the law’s employer mandate.

However, he said critics would have a tough time winning in court because Congress lacks the so-called “legal standing” to present the case and they would have a “tough time” finding somebody hurt enough by the delays to be a good plaintiff.

“The president knows this is wrong,” said Lee, among the most outspoken ObamaCare critics. “What gives him the ability to rewrite the law?”

If the senate remains democrat majority, the house should still initiate impeachment. It is better to initiate the process and let the dems be on record as supporting the criminal as they did Clinton. And drag him through his own feces for 2 years.

“He’s not saying it shouldn’t be done if such a viable legal situation happens.”

Quite right, Lee is not saying this BUT HE IS DOING IT. Very “smart”.

The pubs are loathe to pursue challenges because they fear domestic unrest. They hope to undo the damage after o is gone. Not realistic.
The bottom line is that congress is full of very wealthy men; and rich conservatives are financially at risk if society goes boink.....if they are pauperized with hiring attorneys to defend themselves from federal agencies whose heads are committed to revolution.....if the banks close...if they are detained......if the EPA and NLRB war against their businesses or those in which they have interest.

The situation is not quite bad enough for then to pledge their sacred honor and fortunes....their lives. They, rather, think wishfully for devine Intervention.....or simply to be on the suriving side at the end of this ague.

They have allowed o to proceed unchecked too long. Critical mass is close or past. We descend, I think.
My unlearned opinion.

It is no skin off Valerie’s nose, she is not going to be impeached.

It’s going to go both ways if we ever get into the white house again

No it won't. Republicans never play hardball like the RATS. When the RATS run the House they demand party unity, and take away committee posts if members buck the speaker. The Pubs don't. The Senate pubs refused to use the "nuclear option" to get judges voted on. Harry Reid had no such qualms.

As a side note to this thread, did anything prevent patriots from electing 2/3 conservative majority control of both Houses of Congress by the 2012 elections, such a possibility evidenced by RINOs taking back the House in 2010? I ask this question because, if this scenario had taken place, then Congress would have had the power, under the Constitution’s Clause 2 of Section 7 of Article I, to override presidential vetoes, and we probably wouldn’t be in the mess that we are now in with Obama, Democrats and RINOs.

With a complicit media, and a public with its head up its anal passageway, there is not much chance for anything to be done about it.

The House has the power of the purse and they should use it to defund Obamas pet projects immediately.

If you paid attention you would know they have been doing exactly that.

Appropriations bills were never brought up in the Senate.

We lack the raw political power to prevail

Which is it Bert? The House has defunded Obama or the House lacks the political power to do that?

Trey Gowdy explains the “standing” issue - no guarantee on how courts would “rule”. Mike Kelly on the Kelly file said there needs to be a public outrage.

3 things we can do:
– 3 clowns up for ambassadorships in the senate –advice and consent clause
– House is appropriations – cut the money
– Pursue standing law where we have institutional standing based on vote nullification
– November - citizens will vote accordingly

The following video and article are from December 2013 in which Gowdy explains that Congress is pursuing a law for institutional standing based on vote nullification.

Not against Obama while Reid is in power. But when Republicans again control congress, and the office of the POTUS, they need to seriously clamp down on the abuse of power by the presidents.

All Republican candidates for POTUS must be willing to do this. If they say *they* can handle the power and use it wisely, they FAIL. It is the unconstitutional power itself that is the enemy, not who wields it.

Both..... they voted to defund but it was not because the senate wouldn’t follow through.
