Republicans: Obama violating Constitution, but little can be done about it
foxnews.com ^ | February 16, 2014

Washington Republicans on Sunday restated their argument that President Obama has violated the Constitution by using executive orders to alter the Affordable Care Act, but acknowledged they likely have no recourse or ability to stop another incident.

Sen. Mike Lee, R-Utah, told “Fox News Sunday” that congressional Republicans think the president abused the government’s separation of powers by using the executive orders to sidestep Congress and delay the law’s employer mandate.

However, he said critics would have a tough time winning in court because Congress lacks the so-called “legal standing” to present the case and they would have a “tough time” finding somebody hurt enough by the delays to be a good plaintiff.

“The president knows this is wrong,” said Lee, among the most outspoken ObamaCare critics. “What gives him the ability to rewrite the law?”

Impeach his sorry ass!

The “checks and balances” in our government might as well not exist if the Congress does not have the guts to use the tools they have to “check” the power of the executive branch.

Republicans never play hardball like the RATS.

Friendly amendment...

GOP-e never play hardball like the RATS.

I think Cruz, Lee, et al would do what it takes. They just need to upset the gop-e and they're on that path.

He's not doing what it takes right now.

Whimper, whimper, we can't find one single American who can prove they've been harmed.

Abject cowardice.

Take a shot, you haven't a damn thing to lose if you're genuine.

Does anyone think that the Democrats would be this timid if the roles were reversed?

Lesson learned: Never elect eunuchs to positions of responsibility. Fix that later (If we get the chance)

Nice to read your rare posts. And sense your disgust, which we all share.

I think this remark by Lee is... turn everything red this Nov. and then we can overturn, repeal, nullify everything zero has done. A GOTV-type statement.

The constitutional recourse is impeachment, but that will never happen with the corrupt jury in our Senate. The backup is to cut funding, which needs a lot more backbone from the Speaker of the House. Otherwise, our only remaining option is prayer, and I’m not sure God is on America’s side (or more accurately, I’m not sure we’re on God’s side).

no judge and certainly no politician -- wants to go down in history as the one responsible for impeaching or removing the first "black" president

BINGO! I have been saying this all along.

Impeachment just ain't gonna happen. They are going to build monuments and declare national holidays in this guy's name.

Best case scenario is he serves out his term and dies of natural causes shortly later. Otherwise he becomes Carter/Jackson/Sharpton combined and is a PITA for the next forty years.

Horror of horrors is he gets assassinated, sparking a race war and becomes a martyr and national hero.

I suppose some miracle could happen. We can hope and pray; but it looks pretty grim to me.

Trey Gowdy explains the “standing” issue - no guarantee on how courts would “rule”.

So that's a reason not to try?

Here's an idea for Congress the next time that we have some control over it:

Pass laws giving standing to citizens to challenge unconstitutional actions by their government. Take jurisdiction from District courts for hearing challenges to laws passed by states.

Republicans: Obama violating Constitution, but little can be done about it.

BULLSHIT!

They claim that they lack "standing', because they can't demonstrate injury or damage as a result of the president's unconstitutional behavior.

Hello??!!??

What can be more damaging than being rendered irrelevant in the constitutional structure of government?
Unable to perform their sworn duty?
Unable to exercise the most treasured power over the national purse?

I refuse to believe that the GOP can't garner the legal muscle to pursue the obvious.

Thank you for your kind words.

However, unless Lee's remarks were extensively edited, why didn't he say plain and simple that we can "overturn, repeal, nullify everything zero has done?"

Why are we supposed to infer what he meant?

Say it out loud, for the love of God, and declare yourself a warrior and at least try.

*****

Trey Gowdy didn’t say “no guarantee on how courts would rule” that was my comment.
From the video posted 2.14.14 he mentioned it again so they are going forward with the institutional standing based on nullification of vote.

If Clinton could be impeached for lying to a grand jury, surely Obama could be impeached for something he has done. But he is black, so nothing will happen, no matter what he does.

One thing we can do is strengthen the laws once we get in power

We have very strong laws as it is... It is better to defang the monster of big Gov't. Fire half the people on the federal payroll.

Ted Cruz indeed does to overturn, repeal, nullify everything zero has done... when the power is amassed to do it.

I think it is not being said out loud, nationally, to keep the RATS at home this Nov. It all theoretically sounds like election rhetoric in the minds of the lo-info-voter.

What’s going on now is a silent ground game that nobody hears about, except those being be-mantled with carrying out the GOTV.

Grassroots Silent Running, is the best descriptor I have right now.
