Whoa! Don't they swear an oath to uphold and defend *the Constitution*?! How could legislators swear to uphold the law, anyway? It's their job to change the law.

But Mr. Holder said when laws touch on core constitutional issues like equal protection 2nd Amendment rights, an attorney general should apply the highest level of scrutiny before reaching a decision on whether to defend it.
