A former Navy football player was found not guilty of sexually assaulting a fellow midshipman at an off-campus party nearly two years ago.
A military judge, Marine Corps Col. Daniel Daugherty, found Midshipman Joshua Tate not guilty on Thursday morning at the conclusion of a court-martial at the Washington Navy Yard.
Tate was facing up to 30 years in prison if he had been found guilty.
Tate also was charged with making false statements to investigators three times. Daugherty sent those charges back to Naval Academy Superintendent Vice Adm. Michael Miller for reconsideration. As commanding officer, Miller has the final say on whether to prosecute under military law.
Daugherty said Wednesday that two other midshipmen accused of lying in connection with the case ultimately were not prosecuted in court and were punished administratively at the academy instead.

The woman is a senior. For her to allow herself to be in this position, she showed a complete lack of judgment and leadership skills.
The other three cadets, showed the same, because not one of them tried to stop the situation, which was evidently going to be a disaster.
All four should be bounced out of the Academy. I would not want any of them in an officer’s position.
My ROTC detachment had a total of 100 (+/-) cadets. We built friendships that have now spanned more than 40 years. I can't imagine a situation like this occurring in my day.
Male cadets dated female cadets; a few married upon graduation. How pedestrian! lol
It continues to pay off today. For the fun of it, I'm taking a wine at viticulture class at the local CC. In a few weeks, I'll be giving a presentation on German wines, at the request of the professor. Although he refers to me as the "German expert", I reply that I'm merely the grizzled veteran of dozens of winefests on the Mosel.
Indeed it is working very effectively - the military leadership has been purged of anyone who would dare protest.
Back in olden times (my day), there wasn’t supposed to be any PDA in the military between couples, but the homosexuals have been told to go for it - don’t be shy! Unwelcome advances? There’s no such thing now.
Wanton overt destruction of the Military is the goal. We expected that from Obama, but never did I expect he would have absolutely no effective resistance from the “Other Side.” So, they all need to be hung, IMHO.
