The NBA didn't tape Sterling. They heard the tapes on TV. So he has no claim against them for that. And "free speech" is a right the Government can't infringe; Sterling voluntarily signed the NBA Agreement, which gives the Commissioner carte blanche to punish him for "conduct not in the best interests of the NBA."
He may have a lawsuit against whoever taped him, but not against the NBA.
