GOP fury after report claims IRS 'recycled' Lerner hard drive

The top Republican on one of the House committees investigating the IRS targeting scandal reacted furiously late Wednesday to a report that ex-IRS official Lois Lerner's hard drive had been recycled, making it likely that many emails sent to and from Lerner prior to the summer of 2011 will never be recovered.

The Politico report cited two anonymous sources, as well as Sen. Orrin Hatch, R-Utah, who confirmed that the Senate Finance Committee had been told that the hard drive had been discarded.

"If the IRS truly got rid of evidence in a way that violated the Federal Records Act and ensured the FBI never got a crack at recovering files from an official claiming a Fifth Amendment protection against self-incrimination, this is proof their whole line about 'losing' e-mails in the targeting scandal was just one more attempted deception," House Oversight and Government Reform Committee chairman Darrell Issa, R-Calif., said in a statement. "Official records, like the e-mails of a prominent official, don't just disappear without a trace unless that was the intention."

I think you’re probably right. Remember, Obama refused to turn over his Blackberry when he took office. The Blackberry has probably been replaced by something more modern, but he clearly wanted a way to keep people from knowing who he was talking to.

I always thought it was against the law for people to be conducting government business on their private phones or laptops, although Lerner has claimed that she had a “personal” computer at the office. However, then she and six other people claimed that mysterious “crashes” had destroyed all of their files and somehow there were none on the server...so she can’t even keep her lies straight.

What they have been doing for the last year is going through all the emails and purging any trace of this correspondence, but they’re still afraid something might linger, so now they’ve gone to a set of strangely specific “crashes” which supposedly made everything just vanish into thin air.

Interesting! I didn’t know that outlook files are stored in Canada if you use a blackberry. You do know who has a Blackberry, right? It’s Obama, who refused to hand it over and use an officially provided and secure phone.

I’d bet other people in government still use them too.

LOL. You give way to much credit to the American public. I’d bet <10% understand how email, servers, backups, etc. are handled.

why didn’t they ask for it before now..

Up until a couple of weeks ago, they were being told the IRS had all the emails in their system, and were working of producing them. They weren't told anything about the hard drive crash/lost emails until after the drive had been destroyed.

Even on a level of basic understanding, the NSA scandal uncovered by Snowden proved that what we do and say is never private or unrecoverable. I would think the people of this country would at least understand that, but perhaps I’m woefully optimistic of this nation’s intellectual capacities.

Well, the IRS may claim that they are unable to retrieve those emails, however Lerner was corresponding with the FBI, the White House and members of Congress as well. Those emails exist elsewhere. Plus there’s that little matter of the IRS having released 1.1 million confidential taxpayer records to give the FBI ammunition with which to investigate and prosecute conservatives, which is a felony.

It might be time to review the 2nd article of impeachment from 1974 against Nixon, particularly:

Article 2

Using the powers of the office of President of the United States, Richard M. Nixon, in violation of his constitutional oath faithfully to execute the office of President of the United States and, to the best of his ability, preserve, protect, and defend the Constitution of the United States, and in disregard of his constitutional duty to take care that the laws be faithfully executed, has repeatedly engaged in conduct violating the constitutional rights of citizens, impairing the due and proper administration of justice and the conduct of lawful inquiries, or contravening the laws governing agencies of the executive branch and the purposed of these agencies.

This conduct has included one or more of the following:
He has, acting personally and through his subordinates and agents, endeavoured to obtain from the Internal Revenue Service, in violation of the constitutional rights of citizens, confidential information contained in income tax returns for purposed not authorized by law, and to cause, in violation of the constitutional rights of citizens, income tax audits or other income tax investigations to be intitiated or conducted in a discriminatory manner.

He misused the Federal Bureau of Investigation, the Secret Service, and other executive personnel, in violation or disregard of the constitutional rights of citizens, by directing or authorizing such agencies or personnel to conduct or continue electronic surveillance or other investigations for purposes unrelated to national security, the enforcement of laws, or any other lawful function of his office; he did direct, authorize, or permit the use of information obtained thereby for purposes unrelated to national security, the enforcement of laws, or any other lawful function of his office; and he did direct the concealment of certain records made by the Federal Bureau of Investigation of electronic surveillance.

But, this was no accident. Yet another charge, “destroying evidence to avoid prosecution”.

I seriously doubt IT people knowingly destroyed evidence. Management knew what the retention policies were so, they stonewalled until the emails evaporated.

I don't care what the GOP feels or what they say. They do nothing. The IRS scandal has been going on for over 400 days. What has the GOP accomplished? Judicial Watch got emails before the GOP did.

We're almost to the June 29 second anniversary of the GOP voting Eric Holder in Contempt of Congress. What have they done in follow up?

Dear GOP "leadership", one reason your member Eric Cantor was fired, was that it was seen that the GOP does not fight. Save yourselves, and start fighting.

For ANY of the House investigations to be anything but a sick joke, the House needs to arrest Lois Lerner and Eric Holder for contempt of Congress. NOW.

I think we need to jam our Reps’ phone lines demanding that those 2 be arrested.

Bingo!

The GOP was given the majority in Congress to oppose Obama. They've never figured out that this is their job description. They've done nothing, but look out for themselves and their re-elections. The GOP-e doesn't understand what their job is. And apparently, the Eric Cantor shellacking isn't giving the GOP-e an education. It's a fluke.
