Feds nix eagle penalties for California wind farm (Whack away!! Free Pass!!)

FRESNO, Calif. (AP) — A California wind farm will become the first in the nation to avoid prosecution if eagles are injured or die when they run into the giant turning blades, the U.S. Fish and Wildlife Service said Thursday.

The Shiloh IV Wind Project LLC, 60 miles east of San Francisco, will receive a special permit allowing up to five golden eagles to be accidentally killed over five years. Previously, such a violation could potentially draw criminal charges and discourage private investment in wind farms known for catching birds in their rotors.

The permit will require the facility to take steps to prevent eagle injuries and deaths from electrocution by retrofitting 133 power poles. The permits are not required of wind farms, and federal prosecutors have only once filed criminal charges against a wind farm, in Wyoming.

They will do SSS until caught, which will count one against the 5.

Meanwhile, a citizen (bless his poor unappreciated soul) cannot even possess a single, solitary feather of one of these ‘protected’ birds. No matter how collected — even if picked up off the ground.

And, said citizen, when questioned at trial about the taste of spotted owl, replied: it is kind of like bald eagle.

Norm! So much for obeying the law. The USF&WS is responsible for the birds covered by the Migratory Bird Treaty Act. The Golden Eagle is on the list of protected species.

I’m surprised the Sierra Club hasn’t filed a law suit.

FR: Never Accept the Premise of Your Opponent’s Argument

The feds need to justify all their official actions, in this case penatlies by the U.S. Fish and Wildlife Service, with delegations of specific powers granted to them by the states via the Constitution.

Regarding the Shiloh Wind Power Plant, can anybody show me where the feds purchased the land where the wind power plant was built, either by paying the state for state land with the state's consent as required by the Constitution's Clause 17 of Section 8 of Article I, or by paying a private land owner under the 5th Amendment?

Also, who paid for this wind power plant if it is not on land purchased by the feds. Or if plant was built on federal land and with federal funds, it remains that there is nothing in Congress's constitutional Article I, Section 8-limited powers to justify appropriating tax dollars for such a project.

So it's okay to kill golden eagles in California because it gets in the way of a wind farm, but it's not okay to graze cattle in a Nevada desert because of a desert tortoise?

It must be great to have such situational ethics.
