N.C. police officers accused of faking 911 calls to gain entry...

A North Carolina police chief has officially barred officers from making up phony 911 calls in order to gain access to private residences without a search warrant.

Several officers with the Durham Police Department lied about 911 hang-up calls to convince residents to consent to searches of their homes, an officer said under oath in late May, a local ABC affiliate reported.

The allegations prompted Police Chief Jose Lopez to send out an internal memo barring the practice.“It has recently been brought to my attention that some officers have informed citizens that there has been a 911 hang-up call from their residence in order to obtain consent to enter for the actual purpose of looking for wanted persons on outstanding warrants,” he said in the memo, Raw Story reported.

“Effective immediately no officer will inform a citizen that there has been any call to the emergency communications center, including a hang-up call, when there in fact has been no such call.”

...Courts have determined that cops can deliberately lie to gather evidence under probable cause.

Works with the guilty, not with the innocent. Wouldn't be so hot to have to tell a criminal "we know you did it, but we got nothing". If you've got nothing to 'fess up to, no harm done. Just say NOTHING except name, address and date of birth if questioned, followed by the word ATTORNEY.

I had this happen to me once. It wasn't until just now that I realized it was probably a lie.

It did to me too but I found the source LOL. About 1:00am 15 years ago the K-9 patrol deputy comes up my driveway. My overzealous Lab had warned me. I went outside once I saw it was a patrol car. The K-9 was barking, my dog was barking, Officer was yelling are you OK? I yelled yea. He said we got a 911 call from here. I said I didn't call. End of it he left. I went in the house and picked up my phone and I could hear popping and cracking on the line along with dial tone then I would hear it start ringing a line somewhere.

Here's what happened. Phones lines even today due to a federal law are required to work on rotary phones. The trouble in the phone line was opening and closing the circuit just as a rotary phone does and the central offices recognizes it as a number. My phone line called 911.

I called the sheriffs office {from my computer dial up service phone line} and told their dispatch what was going on. It was a new one on them.

Pretty stupid if they tell the resident there was a hangup 911 call made from their address, in an attempt to illegally gain entry. All 911 calls are recorded with time stamps and address and phone# documented where the call was made from.

How would they explain no record of this in court?

I don’t know if this is still the case, my house has a main phone box on the outside of my house in the back. You can plug a phone in there and make a call.

I heard that someone called the white house from a neighbor’s home and made threats against the President. The homeowner was investigated and put on the do not fly list. Could be an urban legend.

The outside of the phone box has a phone connection. You have to be at the box to do it, but not inside the house.

As long as the person has the wherewithal to hire an attorney to subpoena the records. They won’t hand over those without a fight, I’m sure.

On a related note: A member of Congress can lie to the Citizens at will, but if a Citizen lies to A member of Congress, said Citizen has committed a felony crime. A member of law enforcement can lie to a Citizen at will, but if said Citizen lies to a member of law enforcement, said Citizen has committed a crime for which they can be arrested.

That doesn't sound as if we are all equal under the law , does it?
