someone is seriously misinterpreting the law. While it is certainly true that you cannot overcharge someone who is an athiest, you can discount from your published menu prices for any variety of reasons....school colors, Colts football jerseys, birthdays, anniversaries,over 65’s, whatever, and a prayer should be no different.

They think they are a "god". So if they talk to themselves or each other....they are praying.

the restaurant isn’t a govt body or a publicly held corporation. as a private organization, they can set their pricing model however they’d like.

you may say it’s discriminatory... but in the US, you have a right to discriminate all you like in a private company. this was confirmed by the SCOTUS in the boyscouts vs homo-predators ruling.

this is how certain groups are able to restrict whites from attending meetings

You can sue anyone for anything you like. The key question are:
1) Will a court that has jurisdiction agree there is merit to the case and allow it to go to trial?
2) If the issue has merit, will the court agree you have “standing” to bring the case?
3) Can you afford to hire an attorney to represent you and argue the law in front of the court?

Answer the above in the affirmative and you can sue.

What a joke.

Atheism is not a religion. Therefore it has no say in any laws that protect the practice of religion.

The 1st Amendment protects the practice OF religion - NOT it’s NON-practice.

It’s to prevent a government-sponsored religion from arising and blocking the practice of non-government sponsored religion.

Therefore it has no effect against NON-practice of religion - right? It only protects the PRACTICE of religion.

The NON-practice of a religion doesn’t exist under the 1st Amendment. The only way the non-practice of a religion could even be identified, is if there was a religion against which it could be compared, and in that comparison, be shown to not be being practiced. But, the 1st Amendment prevents the establishment of a government religion. So there’s nothing to compare the non-practice of a religion against, to say that it is the non-practice of religion. In other words, there’s no legal way to prove that a religion is not being practiced. You can only proved the opposite - that a religion IS being practiced.

And it’s that PRACTICE of religion that the 1st Amendment protects.

Otherwise, the only way to interpret the 1st Amendment would be to ban ALL religions from being practiced because they contradict each other in their practices - but that would reverse the stated intent of the law.

Therefore it is impossible for an atheist to demand equal rights under the 1st Amendment, because the atheist does not practice a religion that can invoke 1st Amendment rights to be protected while being practiced. Because not practicing ANY religion, is NOT the same as practicing A religion, because NON-practice can’t be defined as a form of religious practice - by definition.

Once upon a time I would have had sympathy for the restaurant and all of its supporters but that was just before the smokers became the first pariahs....

They warned of the dangers of the tyranny of the minority........LOL!
