Charges Dropped For Cop Who Fatally Shot Sleeping 7-Year-Old Girl

The shooting happened just after midnight, back on May 16, 2010.

A SWAT team had conducted a raid to search for a murder suspect. Weekly ended up being first through the door.

There was even a film crew on hand to film for a reality show about murder investigations. Weekley says that another SWAT member had thrown a flash-bang grenade, which temporarily blinded him. That’s when he fired the shot that killed Aiyana who was asleep on the couch in the front room of the house.

Doubling down on this claim, in court he actually testified that Aiyana’s grandmother had somehow “touched” his gun, which made him fire the shot. But he failed to explain how he could tell she had done this when he claimed he couldn’t see anything at the time.

The prosecution noted that even having his finger on the trigger of his submachine gun was improper. “He could have avoided injury if he had followed his training,” Assistant Wayne County Prosecutor Robert Moran explained.

“He didn’t, and as a result of him not following his training and not following the mandates of ordinary care, someone was killed.”

But ultimately, the arguments and reason didn’t win out.

According to this article, the officer reported that he was blinded by flash-bangs, and fired into smoke. Blindly. What would happen if you or I had fired blindly into smoke.

Even if we had not hit ANYONE, we would face serious charges.

So true, but I seriously doubt that you would ever have a SWAT team sent to your house.
These are sensationalism as its worse, getting JUST your kind of reaction. I wouldn't ever have a SWAT team needed for me or my actions either.

However, these stupid stories are what many people thrive on. They actually think they are real. I doubt MOST of them.

I believe this is a travesty. This kind of policing needs to stop. There is seldom a good reason for EVER breaking down doors. The only exception I can imagine is if there is a life and death situation kidnapping etc. I don’t believe the cop purposely shot that girl but he certainly is negligent and the whole concept of raiding a house is crazy. It puts both the officers, innocents, and those they are hoping to arrest at greater risk of this kind of thing. There are plenty of cases where cops raid the WRONG house. I usually support the cops on most things but this was not justified.

These were criminal charges where the prosecution has to show intent to harm.

They will pay big time in the civil case I assume will follow.

Where I live, there are four variations to numbered streets (actually, eight, if you count avenues, as well). For example, we have four versions of 1ST ST (the directional comes at the end of the address in our area), 1ST ST SW, NW, SE, and NE. Same with avenues (1ST AVE SW/NW/SE/NE). Signage is better today, but when we first moved to the area, the signs didn't have the directional identifier on them.

When we first moved into the house we occupied for nearly 9 years, we got a visit from some confused local Deputies who didn't know the variation on the streets, looking for a parolee who shared my first name, and the street address, but the NE version where ours was the SW. You can imagine what could have happened were it a worse issue than a parole violation and SWAT being involved.

THIS is why people are losing respect for cops. They can kill without prosecution and they are not responsible enough to handle firearms.
