Grand Jury Declines to Indict NYPD Officer in Eric Garner Chokehold Death: Sources

A New York City grand jury has declined to indict an NYPD officer in the chokehold case of Eric Garner, the unarmed man who died while being arrested on Staten Island earlier this year.

In opting not to indict, the panel determined there was not probable cause that a crime was committed by NYPD officer Daniel Pantaleo, who was seen on a widely watched amateur video showing him wrapping his arm around Garner's neck as Garner yelled, "I can't breathe!" during the summer altercation.

Kinda funny when the CommuNazis are a victim of their own nonsense.. Like swarming one individual for selling cigarettes like he just mowed down a group of church-goers with an Uzi.

This was NOT a choke hold. In the video I see a take-down using the 'seat belt' maneuver. The OUTRAGE here is the disproportion of 'crime vs. punishment rendered'.. Way out of balance here. Selling cigarettes? OMG!!!! If this man were selling POT the cops probably would've left him alone.

Btw, it wasn’t all of them who cheered; some were horrified. The “protest” was supposed to be just on the high school campus. But when it started, some genius decided to “take it to the streets,” so they were being accompanied by cops on bicycles to get them through the intersections (since they didn’t have a permit and thus the intersections weren’t already blocked for them).

They should all have been charged with something. Instead, everybody walks.

Why? From what I understand, because of the mans weight he already had breathing problems. How would a police officer know that? Any other man wouldn't have died from this. Should the officer have stopped everything and called someone to check this guys health records before confronting him? Really?

The cop could have shot the guy and FR would not be buzzing with this much anti cop hate. Instead, half of FR wants this cop arrested despite the grand jury’s objective decision.

For the record, the “sugary” drink ban was one of the two that Bloomberg lost. The other was “the car of the future.” But he won all the others.

“The cop could have shot the guy and FR...”

Yea, or given him CPR.

Acutally, this case is 100% proof that a video of an incident is not the be all, end all.

I doubt this guy would have put up any resistance to arrest had he not have been arrested 31 times for other offenses. I don’t know if they were misdemeanors or felonies, but he was no saint.

I believe many around here are willing to indict this cop as a trade off in their mind to ease the tensions that have been created over Ferguson. I admit to thinking the same myself until I started thinking that perhaps I can’t tell the whole story from a video.

The Grand jury came to this conclusion. Until I see that they were way off base, I won’t deride them for doing their job.

At the worst, there was more than one guy subduing this fella. How do we know who did any damage if any, caused by cops? I see the same already judged and hanged behavior right here on FR that I saw on MSNBC.

As far as I know, no FReeper was on the Grand Jury, but it seems this time, we are, without any real knowledge about what we are talking about, are willing to decide we know better than those presented with evidence. Evidence that was not weighted by any defense evidence as in Ferguson.

If there were to be any charges, and there still could be, this case wouldn’t pass muster for anything other than negligent homicide.

Another consideration is that maybe our overlords wanted a no true bill here too. Just a thought!

Probably so. If so, there should be evidence that says that. Either the jury iqnored the evidence, or the evidence wasn’t as obvious as it seems it should have been.

My major point is that until we see the evidence that they saw, we don’t know. But in this corrupt world we have today it is not unreasonable to suspect that they iqnored the evidence - just like the whole world has been doinq reqardinq about 5 “scandals” involvinq this lawless reqime.

The distrust of the system and of normal people is a result of the routine corruption that we’ve come to expect because nobody will ever stand up to it. We’ve learned the system cannot be trusted and people are stupid. So we all feel defenseless. Because we are. That’s what the corruption has created - a doq eat doq world where everybody has to look out for number one because there’s nobody else willinq (and/or able) to look out for us.

Yeah, they piled onto a fat guy. That’s deadly. They knew it. They heard him gasping and pleading that he couldn’t breathe. And watched him die. They’re a gang of savages.

There must’ve been some sort of endangerment type charge that they could be convicted on. Instead, the DA went for the big one knowing he’d lose and not be a “rat” to his LE buddies.

“Homicide” doesn’t necessarily mean “crime.” Correct me if I’m wrong.

No, you're correct. It means one person's death was caused by another person. The cop killed this man by compressing his breathing tube, according to the coroner.

Whether or not its a crime is a legal matter.

If cops let up on perps every time they protested “I can’t breathe! The cuffs are too tight! You’re hurting me!” then they’d rarely get anyone into custody, genius.

Interesting comments.

I was not objecting that but to your comments concerning “brothers”, etc.

Just didn’t think those were appropriate.

There was a fight between Garner and another guy over cigarette turf. Why is no one mentioning this? The police got involved to break up the fight. It is probably something that happened during the fight that caused the incident.

You were wrong about everything in that poorly written piece. Don't get mad at me for pointing it out.

Or maybe you meant the "genius" comment sincerely. If that's the case, thanks!

The NYC cops are completely insane and will kill anybody at anytime for any reason

They can depend on backup from their comrades and the corrupt legal system.

I have had them point guns at me twice.

Once for good reason (passenger in my idiot friend who couldn’t drive to save his life fathers car, who after crashing into a couple of parked cars IN FRONT of a cop car decided that a high speed chase was in order) , and once while buying some beer in a Bodega and a wild eyed cop from Long Island on drugs burst in and was having some kind of psychotic episode (luckily his buddies intervened).

That being said, just because the chokehold is prohibited by NYPD doesn’t translate into a homicide charge.

The black had health issues, it’s not like the cop tased him 15 times or cracked open his skull with a billy club.

Are you saying that because NYPD prohibits the chokehold the cop should be facing charges?

I admit to thinking the same myself until I started thinking that perhaps I can’t tell the whole story from a video.

Unfortunately, this death is yet another democrat vote and TV ratings gold mine. Just because the MSM reports, it doesn't mean what they're reporting is the whole story. MSNBC still refuses to report the Ferguson facts.

The jury made their decision for a good reason. Unless everything comes out in the open and the evidence says otherwise, I have to - in clean conscience - side with the officers and trust the people of the jury.

Too many people here are watching a short clip of a video and are already demanding the crucifixion of a police officer. Why aren't they just as interested in what the jury saw and heard as well? Why all the knee jerking? Have they been trained to believe this whole "cops kill more blacks" crap by the liberal media? Is their propaganda really that powerful?
