Pulled off of Ismaaiyl Brinsley's Facebook page, this shows an interaction taken exactly a year and a week ago where he refused to have his bag searched by police after they claimed the dogs signaled them to his bag. - See more at: http://m.liveleak.com/view?i=d35_1419127560#sthash.0swXg6Ci.dpuf

I call bs on this. Don't know if anybody else saw this but it is starting to make the social media pages of the left and because a dog sniffed his bag they are saying this is justification for murdering cops.

I have an issue with these types of searches. It is amazing the garbage people put up with in this country.

I just want more background of the vid. Was this him? Where was he? What type of Officers are doing the inspecting? Why are they doing the inspection? What was the result of the search? Was this staged to fulfill the prophecy of the leftist narrative?

I could put an apple in my bag and produce several of these videos a month. I think he created this situation himself to play victim.

Remember when some black figure in the 90s claimed dogs were prejudiced?

It's also amazing how many on FR have expressed that it is OK because "of the places and circumstances". Some want to have their Constitution while flushing parts of it down the toilet.

My guess based on Katz is that some situations that occur on public transportation may not protect against the "expectation of privacy" clause. Florida v. Jardines held that search by a drug detection dog(s) is considered a Fourth Amendment (What were Kennedy, Roberts, and Alito thinking) breach in/around a private residence. Before a "sniff" search on a private residence, PC plus a search warrant would be needed.

This video only shows a partial view of the whole situation. Who knows if the police had other PC on the suspect as well.

On a case-by-case basis, you may be correct for this instance. It has been reported that NYC has areas where the cops perform a lot of random stop and frisk actions "as a matter of course". Some here are good with it even though they have to use Roberts-like "rationale" to support it. The 4th Amendment doesn't have loopholes for gut-feeling/high risk neighborhood, etc., - it is to protect INDIVIDUALS for such illegal heavy-handed searches.
