Washington Man Who Faces Years In Prison For Growing Medical Marijuana Has Cancer
A Washington state man who is facing at least 10 years in prison if convicted in a high-profile federal case over growing medical marijuana for personal use has been diagnosed with cancer.
--snip--
Harvey, along with his wife, Rhonda; their son, Rolland Gregg; Rolland's wife, Michelle Gregg; as well as close family friend Jason Zucker are all facing federal marijuana charges for growing about 70 cannabis plants for their own medical use at the Harveys' rural home. The family's defense attorneys have maintained the pot patch complied with state law. Washington legalized medical marijuana in 1998 and recreational marijuana in 2012. Still, federal law classifies marijuana a Schedule I substance "with no currently accepted medical use."
The federal government has charged each with multiple felonies, including manufacturing, possession and distribution of marijuana, as well as possessing a firearm in furtherance of drug trafficking.
The family has said the firearms charge is due to the fact that they keep numerous firearms at the house, which is located in wilderness of northeast Washington state, near the U.S.-Canada border, for hunting and defense. But federal prosecutors say the presence of firearms shows the defendants were involved in drug trafficking.
--snip--
In 2014, a federal judge ruled that the family cannot defend themselves against the charges by arguing their cannabis plants were for medical purposes and legal under state law.

Not making excuses. Rather, supporting freedom.
“sell off the excess to your or my kids” - Selling it to your kids isn’t personal use. No argument on that - prosecute away. I have no problems with laws and enforcement, but this is a property rights issue.
I’ll re phrase it........... When was he diagnosed with cancer and when did he start growing MJ?
“.....growing 70 plants isnt what Id consider for personal medical use for just one self-prescribed patient”.......
The article named several family members and friends who were all involved. Seems this is more than “growing for personal medical purposes”. Do they ALL have cancer?

The list I just referred to in my previous post. Must be a “sick” bunch.
This is a federal case so I assume the DoJ is involved. Where does Eric Holder stand on this?
Property rights issue.....let’s take it to the extreme then....suppose they contended they needed an acre’s worth of castor bean crop to address some medical need and that this is all just a property rights issue.
I’ll leave it up to you to find out what you can make from castor beans....it’s extreme for sure, but at some point this freedom of anything property-wise isn’t wise in my opinion.
“allows somebody with a doctor’s prescription for marijuana to grow up to twelve plants for their own use”
Thanks for that info on the WA laws. I can respect the law, but fundamentally disagree with it. To me, it is offensive to be required to engage the medical community just to grow 12 herbs in my garden. I prefer to limit my private information when it comes to big data.
That's a more reasonable question, but it appears to be leading to a conclusion that you aren't sick until you've been diagnosed.
One thing I do every day is make soap. Castor Oil (from the castor bean plant) is an important part of my recipe. If I could extract the oil from my own crop and use it in my soap, why shouldn’t I be able to?
It’s my garden and I should be able to grow whatever I please to satisfy the needs of me and my family. -already stipulated against external external distribution.
So you grow the castor bean then? Or do you buy it? Do you plant the equivalent of say 70 plants of marijuana.....
It could be something else. My point is blind insistence on totally unrestricted property rights (and in this case, I do not agree it is solely a property rights issue, BTW) sounds nice. It is far more difficult to reach some “do not cross line” in practice.
You and I have made our cases and I really don’t have anything more to say actually. I wish you well and good hunting :0)
Shouldn't it be up to the state of WA to deal with this, rather than the feds, per the Tenth Amendment?
Since the CDC appears to have gone on record saying tobacco “Smoking can cause cancer almost anywhere in your body, including the:
Mouth, nose, and throat
Larynx
Trachea
Esophagus
Lungs
Stomach
Pancreas
Liver
Kidneys and ureters
Bladder
Colon and rectum
Cervix
Bone marrow and blood (leukemia)
What do we now about this gentleman’s history let along long term effects of taking Marijuana, medical or recreational?

Just expressing an opinion!
Yes, in its proper context. Another freeper here cited the law that says “up to 12 plants for personal use.” WA state should be the controlling legal authority here.
I am guessing there is more to this story here if the Feds are involved.
I can grow a limited quantity of tobacco in my garden for personal use and enjoyment. I can distill a limited amount of moonshine in my garage. But I can’t grow a couple mj plant in my garden? Why must I have cancer to use it?
I thought the plan was to legalize “it” and then “tax the hell out of it”. How the hell can you “tax the hell out of it” if people are growing their own? He isn’t going to jail for growing happy smoke, he’s going to jail because he wasn’t paying taxes on it.
He's busted more MMJ shops than W by far!
What kind of monster denies the sick, suffering, or dying their choice of treatment or drugs?
Anti gunners place the blame for crime on a gun, not the person wielding it. Drug warriors place the blame for crime on a plant, not the person doing the crime.
Marijuana has more carcinogens in it than tobacco.
Your points are well taken. We’re not that far apart. I’m fine with “draw the line somewhere”. The challenge is deciding where to draw it.
As for the castor, I have a great supplier and have no need to produce my own. But if I ever wanted to....
Good day to you, Gaffer.
