Loretta Lynch meets Ted Cruz. A grand old time is had by all [Watch Video]

We’ll start off the day with some video goodness for you. As previously noted, confirmation hearings for Loretta Lynch, President Obama’s nominee to replace Eric Holder, got underway this week. One of her inquisitors was Senator Ted Cruz (R – Tex) who had plenty of questions, many related to the performance of the current Attorney General and how her approach might differ, if at all. The conversation would, in my opinion, be described as polite and professional, while still being confrontational. This first section (which starts in the first couple of minutes in the video below) deals with the limits of discretion in prosecution.

With regard to the limits of executive power, Sen. Cruz asked, “Let me ask about your understanding of prosecutorial discretion. Would it allow a subsequent president… to state that there are other laws that the administration will not enforce – labor laws, environmental laws – would it allow a president to say every existing federal labor law shall heretofore not apply to the state of Texas because I am using my prosecutorial discretion to refuse to enforce those laws? In your judgment, would that be constitutional?”

Nominee Lynch responded, “Again, I would have to know what legal basis was being proposed for that.”

Sen. Cruz continued, “I find it remarkable that you are unable to answer that question. I can answer it straightforward. It would be patently unconstitutional for any subsequent president to refuse to enforce the tax laws, or the labor laws, or the immigration laws for the very same reason that President Obama’s actions refusing to enforce immigration laws are unconstitutional. And it is discouraging that a nominee who hopes to serve as attorney general will not give a straightforward answer to that question.”

Here’s that first video:

There was additional goodness, involving everything from drone strikes to free speech and whether or not the office of the Attorney General should act as an independent agent in upholding the constitution or as a political arm of the White House. Follow the next two links for the videos of those. Not much more to say here, other than noting that these are the distilled good bits from a long day on CSPAN. (Please note that these videos are not in chronological order.) Enjoy.

Second video.

Third video.

We may want a GOP POTUS to not enforce some law

We had two GOP presidents not enforce some laws, both named Bush. Neither enforced immigration laws to any serious extent. The open border and lack of interior enforcement are the reasons (along with Clinton's eight years) we now have to huge population of illegal aliens we have no.

Most were already here with Obama took office; he just had to gall to begin granting legal status without any action from Congress.

W totally ignored the Secure Fence Act of 2006; he had no intention of doing anything that would made a serious dent in the illegal entries into the US.

Well, well, well, so it is. Sharon Malone, now known as Sharon Holder (AG Holder’s wife) went to Harvard with Loretta Lynch and they were very good friends in an all black sorority as I understand it from another FR post. Getting more interesting every minute.

Levin said it was unconstitutional when GWB was POTUS and then ~ three years later told the GOP to do it when Obama was POTUS. The constitution to him obviously says different things depending on who is POTUS.

If you are going to make an accusation like that, please post relevant details to prove it.

Otherwise, it's just a bunch of hot air on your part.

Sorry SickOfLibs, should have read that more closely.

It has been years since I have heard or read anyone talking about ‘situational ethics’. This was a very heated subject years ago when I was on a church council and the young ,new Pastor and I were reps to the church gathering. The young Pastor was a devotee of the new philosophical trend- God is Dead.

Again what does Cruz's quote have to do with filibustering?

Point number two you made to me:

Under PPACA the HHS Secretary has a lot of leeway shaping rules and regulations. A very cunning and imaginative limited government type Pres. can appoint a likewise cunning and imaginative Secretary to shape the law while still observing the basic requirements passed by Congress.

Cruz will NOT vote to confirm her. Another EZ call.

Levin suffers from selective amnesia. IIRC, he told us to take one in the rear, and vote for Romney. Hannity is still in love with Karl Rove. etc, etc. I quit listening to talk radio years ao, except for a quick listen if there is some insane thing going on in D.C. My (semi) local talk guy beats all heck out of the syndicated guys.

Yes, I know. I pulled the trigger a little too fast on that post.

Already apologized to SickOfLibs. :)

RE:”Well, lets not get too hasty here......”

Yep, that SOL has too big a head already, he is getting downright impossible to deal with... ...someone needs to put him in his place before something bad happens.

Sometimes I just don't understand where he is coming from :)

I know how you feel. I hate people who have more $$$ than me.

Its not fair, I deserve it more than they do...everyone making more than me is obviously too wealthy...even when I get a raise...
