I read up on this story and did a fair amount of research. There’s a fact or two left out of the story. This is Kermit, Texas....way out on the west end of the state, with 6,000 residents. There’s a large segment of town which are Pentecostals in terms of faith.
If you stood around and talked Harry Potter stuff with magic wands, witches, Merlin-swords in stone, temptation by women with snaky-hair, or One-rings...around extremely conservative Pentecostal folks....they’d get all freaked out.
That’s what this story is really about. If you notice...the school director won’t comment in public about this at all. I think he’s embarrassed, but he had some parent who got all peeved and worried about One-ring voo-doo and secret powers.

These idiot educrats can’t suspend or expel them all, they won’t have a job - they’ll lose their little fiefdoms and the school boards will have to address this immediately.

Previous suspensions for bringing in “Big Book of Knowledge” which had a picture of a pregnant woman. Unauthorized sex education? Unauthorized pro-life education? Look at the naked lady snickers?
Another for calling a classmate black classmate black. In anger or insult? Or just matter of fact statement?
After three or four suspensions in six months, I’d be thinking home schooling or moving.
So, it’s either Hogwarts or homeschooling for this kid?
School officials nationwide really need a lesson on true threat doctrine, the legal principle that determines whether an utterance is actually a threat for purposes of law (and thus potentially criminal). The appeals court circuits are split on the definition, some applying a “reasonable speaker” doctrine, others a “reasonable hearer” doctrine, and these latter divided between those that take hearer to be the party to whom the speech is directed and those that take the hearer to be a disinterested third party, but all of them require that the speaker have the means of carrying out the harm spoken of (or purportedly spoken of).
Regardless of which standard is used by the appeals court circuit containing Texas, purported threats in which a magical means is specified are no threat at all.
