BREAKING: Ala. County Must Issue Same-Sex Marriage Licenses

An Alabama federal judge on Thursday ordered the state’s second-largest county to begin issuing marriage licenses to same-sex couples, paving the way for other holdout parts of the state to fall in line.

The ruling from U.S. District Judge Callie V.S. Granade was directed at Don Davis, probate judge of Mobile County, the most populous of several dozen Alabama counties that had not complied with a same-sex marriage ruling that took effect on Monday. Granade’s decision may convince other probate judges to no longer heed an order from Alabama Chief Justice Roy S. Moore to continue refusing to issue same-sex marriage licenses.

"Probate Judge Don Davis is hereby enjoined from refusing to issue marriage licenses to plaintiffs due to the Alabama laws which prohibit same-sex marriage," Granade wrote.

More than 40 of Alabama’s 67 counties were withholding same-sex marriage licenses before Granade’s decision on Thursday. Three-fifths of the holdouts had stopped issuing any marriage licenses and two-fifths were only issuing licenses to opposite-sex couples, according to the nonprofit Human Rights Campaign.

Nor is the use of the U.S. military a viable option by federal authorities. It would be a serious mistake that would backfire on a POTUS (or others) that would order it.

President Eisenhower called out federal troops to enforce a federal court order to desegregate public schools.

I don't know how old you are, but I remember those days, and the public resistance to desegregation in the south in the 1950s was much greater than the public resistance to gay marriage today. As is evidenced by the fact that the Alabama Governor, and the Alabama Supreme Court except for Chief Judge Moore, have explicitly said that they are not going to fight this.

Not what he said at all.

Davis [through his personal lawyer] said to the federal judge today, "some people say that I have to give marriage licenses to gays, Judge Moore says I can't, so you tell me what to do-- I don't care which it is, but I want a court order so I don't get into trouble."

No federal marshal is going to be foolish enough to fire upon state law enforcement personnel.

Unless said marshall has got a platoon of Kevlar-clad boyfriends backing him up, like they did at Bunkerville.

The Left is walking their agenda right up to the line and putting their toes over the edge. They are probing to gauge reactions by the sheeple. They already KNOW the reactions of the low-information voters (they can always count on their support), but the complacent ones they can keep pushing, and there's no end in sight.

The only certainty is that There Is No Voting Our Way Out Of This.

Nope.

The state doesn’t have to do what the feds tell them to do if it’s not specifically enumerated in the US Constitution.

Judges have in no way legitimized abortion or “same sex marriage.” They have only delegitimized themselves. Such is the fate of all who proudly rebel against the laws of nature and nature’s God.

The federal constitution trumps the state constitution and the federal judges - wrong as they may be - have decided that the federal constitution mandates gay marriage. So Roy Moore’s view on the State Constitution aren’t really relevant.

If the Constitution always mandates whatever federal judges claim it mandated, there is judicial tyranny over the people.

Ruth Bader Ginsberg for instance was caught on tape making things up as she went along. Mark Levin played it and analyzed. Her comments were totally unrelated to the Constitution, about gay marriage which will be before the Court and already is, in a way, and she made it clear she’s all for it and believes it will become an easy sell to the people once they must allow it.

She has no clue what all the fuss is about, because that’s her personal view. And she was in a forum in which she spoke as a Justice on the Bench.

So there you have it. Whatever they say, for whatever reason, if that is accepted as law no matter what, then you have TYRANNY.

If that’s your America, it isn’t mine, nor is it the America that was originally founded.

Does this ruling and all these rulings forbid the state creating licenses for anything?

All licenses are an act of state power granting certain categories of persons the power to do a thing, and forbidding all other persons from doing that thing.

Does all licensing violate equal protection rights?

Does a state license to fish on Saturdays violate the equal protection rights of those who desire to fish on Sundays?
