OK let’s go ahead and say this is my fault. As a Colorado resident I had come to think of our “Make My Day Law” (yes that is it’s official name) as being castle doctrine. It’s not castle doctrine, it’s not even referred to as a castle doctrine law. Wikipedia says “The doctrine is not a defined law that can be invoked, but a set of principles which is incorporated in some form in the law of many states.” so therefore my assertions based on Colorado’s “Make My Day Law” are not relevant to “Castle Doctrine”. My idea that someone who has forced entry into your occupied dwelling clearly means you harm and you require no further justification for the use of force is from my having internalized the law which I live under.

All that makes sense (sort of) until a guy appoints himself as Rambo and sets a trap. Again, thats where this went sideways

“I guess “Bait Car” is illegal too then. Go arrest all those Cops.”

Bait Car becomes illegal when the cops bait a car, shoot and injure a perp and then stand over the injured perp and blow his head off.

From the article: “Kaarma fired low three times as Dede scrambled for cover, and then reloaded for the fatal headshot, a detective testified.”

Apparently, the jury believed this testimony.

The home owner was in no danger at any time. Could have just as easily held him at gun point and called the police. The use of deadly force is a serious matter, setting up a situation to use it because you’re frustrated by being ripped off, doesn’t seem to me to be the wisest solution to the problem.

Glad he shot him. Younger people need to realize that lines are being drawn in the sand and thieves won’t be tolerated.

The kid was taking burglar bait and may well have burgled the place before. The home owner set it up with a partially open garage door the killed the punk when he entered the garage. Owner’s big mistake wa that he and girl friend boasted about baiting for the burgla. Punk kid got what he had coming but home owner is going to pay dearly for it though I could not have voted to convict.

Where does that presumption come from? How can the state of no danger from a stranger essentially invading one’s garage at 1 am be determined? much less the ability to hold such a person at gunpoint? Recall similar arguments to Darren Wilson versus Michael Brown?

There is no evidence of a “setup”. Claiming same means that one has to concede that Dede is the criminal, of course.

There’s only one side of the story claiming they “boasted” of doing this.

“Warning: homeowners are crazy and have guns.”

Works for me.

What witness was there of Kaarma doing this? The detective cannot have witnessed that, never mind ballistics demonstrating such an act as portrayed in that testimony.

Wow.

You REALLY hate admitting you might be wrong about something, don’t you?

What makes me wonder about this is I don’t own a gun that only holds three rounds.

If I am expecting a dance any gun I am holding will be fully loaded.

Again, WHO has argued that Dede was not a criminal?

Please name them or please STFU about it.

What’s prompting the emotional response? That only serves to make me think I’m right, remember.

The fact that Dede was in Kaarma’s garage at 1 am is the outstanding fact here.

That’s not the problem. Making one into a murderer for shooting a criminal in his own garage is.

I own a Remington Model 11 shotgun that only holds three rounds.

Or rather, I DID own one, prior to losing all of my guns in that tragic boating accident on the Chesapeake Bay back in November of 2008.

There is no argument more emotional than a straw man argument.
