Judge in Texas orders temporary halt to Obama immigration action

A judge in Texas has issued an injunction temporarily blocking President Barack Obama's executive action on immigration that has drawn opposition from 26 states across the nation.

But United States District Judge Andrew S. Hanen said Monday that the Obama administration had failed to comply with the Administrative Procedure Act. He ordered a halt to the implementation of the measures until he has weighed the full merits of the case.

I’ve been up since very early (left coast time) and FNC has been covering it all morning. Judge Napolitano read the 250 pages and said the Judge did a good job and he thought it would be upheld. Laura Ingraham also weighed in.

I read on another thread that if it is appealed, it goes to the 5th Circuit, which is a conservative-leaning court. And, if it goes up from there, it initially goes to Justice Scalia, who covers the 5th circuit.

Obama and his staff have long argued that the President has the legal right to take action, saying he only acted because Congress failed to pass immigration reform.

This is so arrogant. It's also deceitful because from 2006-2008, they had carte blanche to pass anything they wanted, but they did nothing.

I believe the states' attorneys general, since the states have been declared by this judge to have standing.

Prosecute or no, the states will not have to recognize the legalization of employment proffered to illegal residents, unless and until the injunction is lifted.

Looks like the republican plan to defund DHS is on the
skids and this is some backup plan or Judge Hanen saw it
for the ruse that it was and decided to take things in
his own hands. Of course it could be just more
kabuki theater.

ALL the administration media is missing one important legal point. A temporary injunction is VERY had to obtain.

The requesting party has to show a SUBSTANTIAL likelihood of success on the final merits of the case.

IOE Obama’s grounds for supporting his position are already weak.

How rightfully wrong you are!

Of course Obama and his ring can make faces and moon the judge all they want. But federal workers and federal contractors won’t do a thing if they want to stay out of jail.

The hologram ID card manufacturer is General Dynamics in Corbin, KY. GD is not ever going to risk its future on defying a federal court order over a business that is hardly a fraction of their total. They will cease and desist. And so Obama’s little foray into lawlessness gets plugged.
