Obama Administration Unlikely to Seek Emergency Stay on Immigration Ruling (BS!)

While President Obama has made it clear his administration will appeal District Court Judge Andrew Hanen’s ruling blocking his executive action on immigration, the president’s immigration plan will likely be on hold for months or longer.

Though no final decision has been made, Obama administration sources told ABC News today that the Department of Justice is unlikely to seek an emergency stay to block the judge’s order. The reason is simple: While DOJ thinks it will ultimately prevail on the overall appeal, department officials believe they would not succeed in seeking an emergency stay of Judge Hanen’s ruling.

The judge’s ruling is likely to remain in place while the case is appealed before the 5th Circuit Court of Appeals and, quite possibly, to the Supreme Court. That process is likely to take six months -- or longer. That means the 5 million undocumented immigrants who had been hoping to apply for DACA (Deferred Action for Childhood Arrivals) to obtain work permits, drivers licenses, and relief from fear of deportation will have to wait.

The Senate better stick with the House DHS Bill with the Illegal Immigration restrictions because as soon as they vote on it Obama will get a judge to lift the order then it becomes Unconstitutional law.

They should fund DHS with the House riders attached and if the Senate Dems continue to refuse then don't back down. It could be an Obama head fake.
The other possibility is remove the current riders and attach an amendment that Obama will not go forward with his Immigration Plan until SCOTUS rules.

Barry will issue a NEW EO with different verbiage and proceed issuing work permits, etc.. He'll argue this is new, and it was the original EO that had the injunction against it. Meanwhile, the cat will have been let out of the bag.

That is exactly the opposite legal opinion I’ve heard.

If the W.H. gets the TX judges stay revoked, that means they will probably defeat the stay in the immigration orders by the W.H.

Them not even trying means they know they won’t win. The legal tea-leaves are clear. The immigration W.H. memos will fall.

They get credit for the order and then blame others for the stay

Pull all money out of the bill and now submit a clean DHS bill. Once this bill passes and DHS is funded, come up with another bill for illegals....

Like sending them home.

I haven’t been this happy since the election. This ruling was a head shot. The case has not been heard. The case will take 2 to 3 years to hear off and on with 26 plaintiff States.The Court has other cases to hear so this will be on the docket for a day and it might be a week for the next trial day.
The injunction was entered as a Rule 65 Preliminary injuction hearing on a full record with both sides participating. Appeal would start with the assumption the injunction is necessary to stop irreperable harm. The Government has that burder. With States impacted by hundreds of million of dollars in illeghgal alien costs and the IRS transfering billions to aliens under the “unearned Income Tax Credits” ,irreperable damages are per se. no issue .
The court has not yet ruled on the unconstitutional grab of power by the regime but ruled likelihood of success on the clear violation of the Rule making requirements imposed on agencies ( in this case HSA)including public hearings and 90 day notice requirements. Rules are struck down for non compliance quite easily. This is how obama has blocked Keystone pipeline using dilatory rule making as an excuse but in the illegal amnesty case he just dropped all that.
This is a great day freepers. We have laws and a consitution and this Judge just “bitch slapped” obama to the ground. God Bless America.

From what I’ve read both sides agree there is no EO just some kind of memo which allowed the Johnson clown to write a new law.

does anyone seriously believe obozo, Holder and Johnson will halt their illegal amnesty program as though they all of sudden believe in the credence to our laws?? Congress is no better.
