First Same-Sex Couple Married in Austin [TX]

Sarah Goodfriend and Suzanne Bryant were married this morning in Austin. The county clerk issued the couple a same-sex marriage license based on a court order.

The order, the county clerk's office confirms, will only apply to this one couple, one of whom is "medically fragile." [See the judge's order here.]

"I am happily following the court order, but the court order only applies to this one couple," says Travis County Clerk Dana DeBeauvoir. "And it is based on the idea that there are circumstances with this couple…one of them is medically fragile and they may not survive the wait on what the courts are going to rule in the future as a final decision about gay marriage.

The judge ordered the Travis County Clerk to stop relying on the “unconstitutional Texas prohibitions against same-sex marriage” as a basis for denying a marriage license to them.

Essentially, Sarah is dying very soon and Suzanne wants intestacy rights, homestead rights, community property rights, spousal support, and spousal evidentiary privileges in a wrongful death lawsuit when Sarah dies.

I believe any individual has the absolute right to leave his property, money, and medical decisions to whomever he wants, but that right does not entitle him to a marriage license. The law provides mechanisms for all of those rights.

Then there's Sheila Jackson Lee, AND the fact I can't legally open carry my pistol. I realize folks think Texas is some wonderful bastion of freedom, but I tell ya, I have zero desire to even visit a State that would allow SJL to remain in office.

We got Sheila somehow, although I think the schizoid living under the bridge near here might do a better job.

This morning, a rogue state District Judge in Austin instructed the Travis County Clerk to certify a marriage license for a same sex couple. That license is invalid, just as any license issued in violation of state law would be.

I took immediate action, asking the Texas Supreme Court to stay this proceeding. This afternoon, the Texas Supreme Court granted my request to stay two court rulings that declared Texas’ marriage law unconstitutional. As Attorney General, I will continue to defend the will of the people of Texas, who have defined marriage as between one man and one woman, against any judicial activism or overreach.

Since Obama feels free to ignore court decisions, I guess states can ignore court rulings on this topic too.
