Texas Attorney General: Same-sex Marriage is Void

AUSTIN — Hours after a Texas county clerk issued the state's first same-sex marriage license, Texas' attorney general said the marriage is void.

Attorney General Ken Paxton said Thursday that the Texas Supreme Court granted his request to stay two court rulings declaring Texas' ban on same-sex marriage unconstitutional.

"The Court's action upholds our state constitution and stays these rulings by activist judges in Travis County," Paxton said in a statement. "The same-sex marriage license issued by the Travis County Clerk is void, just as any license issued in violation of state law would be. I will continue to defend the will of the people of Texas, who have defined marriage as between one man and one woman, against any judicial activism or overreach."

According to the Travis County clerk's office, Judge David Wahlberg signed a state court order Thursday, commanding Travis County Clerk Dana Debeauvoir to "cease and desist relying on the unconstitutional Texas prohibitions against same-sex marriage as a basis for not issuing a marriage license specifically to Plaintiffs Sarah Goodfriend and Suzanne Bryant" because Goodfriend has ovarian cancer.

I see that my vote for Mr. Paxton was not in vain.

Good show, lads.

I guess we will see where this goes! But “impeach that judge” is a common theme on his Facebook

What are they gonna do if a governor and AG do that?

Run a search on "Little Rock" + 1957 for your answer.

Wahlberg ran uncontested for election to the 167th District Court....and won, in Nov of 2012. His term is up next year (2016).

Can Judges be impeached, recalled....anything? At the very least...someone needs to contest this lib, in 2016!

God bless Texas!

Austin is the epicenter of te loony Left in Texas.

For too long, there has been no opposition.

When their is no opposition, the Left pushes the boundaries ever outward to achieve its aims.

Without meaningful pushback, they get what they want, and we get the wreckage of a failed society.

It is time they felt the heat.

We want our country back.

The problem here is that that the Homosexual Activist Lawyers succeeded in finding a sympathetic couple to be the plaintiffs. One is dying of cancer, and the issue is inheritance and taxes.

A Federal Judge may find sympathy in this one case and then all the other gays in Texas will claim Equal Protection.

The State Legislature can impeach, but they won’t.

Governor Sam Houston once said: “Texas can make it without the United States, but the United States can’t make it without Texas”

Nope. For reasons I delineated in detail over in the comments section at the Federalist, and which I won't take the time to repeat here, the two situations are completely not alike, and expecting the one today to end the same way 1957 did is a pipe dream.

“Governor Sam Houston once said: “Texas can make it without the United States, but the United States can’t make it without Texas””

Is that why he opposed Texas leaving the Union?

Don’t mess with Texas. If Texas becomes a Republic again, will they allow non resident native born Texans to return to claim citizenship?

This isn’t 1957 and Obama sure isn’t Dwight D.

It would be interesting to see who blinked first.

Not gonna happen. The only person that gets away with ignoring federal judges is Obama.

Since when does a district judge get to determine state law? This dude is a flaming lib that should be disbarred.

If the issue is inheritance - just write a will, already!

“write a will”

Do you know a lawyer who can write a will to avoid federal inheritance tax?
