Senate Dems urge HHS to give FDA authority to regulate e-cigarettes

Democratic Senators are urging the Department of Health and Human Services to finalize tobacco deeming regulations to give the Food and Drug Admnistration regulatory authoirty over all tobacco products including electronic cigarettes.

In a letter Wednesday, Sens. Sherrod Brown (D-Ohio), Richard Blumenthal (D-Conn.), Richard Durbin (D-Ill.), Jeffery Merkley (D-Ore.), Patty Murray (D-Wash.), Barbara Boxer (D-Calif.) and Edward J. Markey (D-Mass.) asked HHS Secretary Sylvia Mathews Burwell to finalize the Family Smoking Prevention and Tobacco Control Act, proposed last April, before FDA Commissioner Margaret Hamburg steps down or within a year from the release date of the proposed rule.

“As it stands, e-cigarettes are being aggressively marketed to children and the use of e-cigarettes by minors has skyrocketed in recent years,” the letter said.  “Teen use of e-cigarettes now surpasses use of regular cigarettes according to recent data from the government-sponsored Monitoring the Future survey, with over 16 percent of 10th graders and over 17 percent of 12th graders reporting use of e-cigarettes during the past month. “

And since the number of calls to poison control for incidents involving the liquid nicotine used in e-cigarettes continues to rise, the lawmakers said the final deeming rules should require manufacturers to use child-proof packaging.

They also asked HHS not to change the grandfather date, saying that doing so would expose children and others to a host of new tobacco products that have not been subject to agency review.  

“Because of FDA’s delay in asserting its jurisdiction over other tobacco products, there are likely hundreds of e-cigarette products on the market today without any regulatory review of their consequences for public health,” the letter said.  “Grandfathering of these products would mean these products would never be subject to a review by FDA to determine whether they are appropriate to be sold, and essentially undermine consumer protections.”

I have not seen one incident of marketing, let alone aggressive marketing to “children”, tell me what would that be, advertising on the Disney Channel or maybe ABC Family, the Fosters, showing two 13 year old boys making out? Let me tell you what excites them, the supposed 16 to 17 percent of minors who have “tried” e cigarettes in one month.......it’s the tax revenue they have lost with tobacco.

I hate the nanny state, BUT if I'm stuck paying the bills for tobacco smokers, then by-gawd I'm going to support nanny-state measures to deal with it!

(Isn't that the argument of marijuana prohibitionists re pot?)

So when did it become the Senate Democrat’s business to tell, to urge, to push the bureaucracies, Leftist as they may be to do anything? Seems to me there are channels, and bipartisan channels at that to get governing done in a manner not suggested, but outright dictated by our Constitution.

It’s beyond time to grab a few Democrats, and RINO’s too by the throat, and shake ‘em up a bit, or just make sure we get rid of them at the earliest opportunity.

It’s the same mentality as saying “Since the Constitution isn’t being followed, I might as well go with flow and instill my brand of tyranny.”

Unfortunately, I have seen few whom pick up the banner of “By what authority is govt doing XYZ, let alone stepping on my 6th and 13th A. Righs by stealing from me to give and/or do XYZ”. Be that smokes, weed, schools, S.S (some even think they PAID for that one! HA), etc.

They have already gone after tobacco years ago. My e-cig. has NO tobacco and no match or cigarette lighter is needed. It looks like a cigarette and the concern govn. trolls don't want me to have something that looks like a cigarette.

We went to a restaurant not long ago, and the sign outside read, “No Electronic Cigarettes Permitted inside.” We left.

If you don't use an e-cig, having regulations put on us doesn't matter to you, however, once they started on real cigs. years ago, I knew it would keep growing until govn. would control what food you could eat and what you could drink and what medicine you could buy over the counter. It has come true and will get worse.

And, you shouldn't have guns, either, and now they are going after ammunition. Likely some of you are now in the categories that are threatened. It all started with cigarettes and I knew it would happen.

I have a Kanger and battery unit that looks nothing like a cigarette. I use e liquid in it that is usually 0 mg nicotine. I was at a local hospital and stepped outside the door about 30 ft away and pulled it out and took a few puffs. A security guard came out and said I wasn’t allowed to use it there. I said well.....it’s not smoking and there is no nicotine so.....how is it regulated as smoking? He just looked at me with this dumb look, shrugged his shoulders and said.....I called and asked about it. Rofl

Oh, sure, my e-cig is filled with opium. /s. Drug delivery devices are also aspirin, mouth washes, cold medicine, drug pills for diarrhea and constipation, drug liquid to stop a toothache, drug to put on a cut, drugs for upset stomach, ad infinitum. PLUS ALCOHOL OF EVERY KIND. If you have any beer or other alcohol of any kind, you should dump it and raise hell until alcohol is outlawed.

In case you don’t know it, you can get your e-cigs with NO nicotine at all in them - 0. Plus, there are levels of nicotine you can choose.

I am aware of those and have a friend who has that kind. I am sick of people who want to tell me what I can and cannot do just because “they” don’t like it.

Some times I go to a casino and smoking is allowed everywhere in there - it’s smoke all you want wherever you want. I went to a machine, sat down, lit a cigarette and the woman next to me at a machine said, “I am allergic to smoke and that cigarette smoke is coming this way.” I moved the cigarette over to my left so it wouldn’t be in her direction. She got up and left.

She shouldn’t be in that casino at all if she really is allergic. She is the only one who has ever said that to me. Most everyone else is also smoking. That is the only place I use real cigarettes.
