The Supreme Court will hear arguments today that could lead to a constitutional right for gays to marry. Many court watchers believe it's a done deal already. In addition to the 4 liberal judges, Justice Anthony Kennedy has already ruled with the majority 3 times against maintaining a ban on same sex marriage. He would appear to be the 5th vote that would make gay marriage the law of the land.
But nothing is certain, which is why some observers believe that Chief Justice John Roberts may be a pivotal vote on the question of same sex marriage.
Putting aside previous cases and previous votes, there are a number of institutional reasons Chief Justice Roberts might, and should, cast a vote for the freedom to marry.
First, a Supreme Court ruling authorizing the states to restrict marriage to heterosexual couples would lead to enormous confusion. The court’s decision not to take appeals of earlier cases, or put other appeals of lower court decisions on hold, has induced many couples to marry. Surely, same-sex couples who married when marriage was legal under prior court rulings would remain so. But if the plaintiffs do not prevail, all of the states that recognize the right of same-sex couples to marry in light of lower federal court rulings could revert to their earlier state of affairs.
(A ruling against the plaintiffs would leave untouched the rights of same-sex couples to marry in the states that have affirmed the right through legislation, ballot initiative or state constitutional rulings.)

Key West? Fire Island? DuPont Circle?
Is there even a question on this?
Yes, the Supremes are going to rule in favor of Gay Marriage. This is a done deal.
Yes he will but, who says you need permission and a license from the state to enter into a union.
Like we never learned from the fiasco of obamaturdcare..
Why not, he rewrote from the bench the “ACA” to make it a magical tax instead.
This case is a done deal. Hell we had Ginsburg actually doing s ham marriage and yet she won’t recuse herself.
This is judicial tyranny and not what the founding fathers had in mind,
Maybe he’ll declare it a tax and call it a day.
He certainly will . His two Irish illegally adopted children’s future depends him submitting to the one.
I’m confident Thomas will vote against requiring gay marriage. I think Scalia might, and maybe, at best, Alito. I doubt there will be more than 3 votes for the obvious meaning of the US Constitution, though. And Thomas is the only vote I consider honest enough to be certain.
Roberts? He’ll vote for the majority and political correctness, to preserve the reputation of the court among DC party goers...
Yeah.
Ethics and honesty are for “the little people” you know.
At least that is the loud and clear message from DC.
Lol!!!
Marriage Licenses are issued by the States. 10th Amendment precludes intervention.
Aren’t those ‘kids’ about 20 years old (or older) now?
The case will be decided via the Strict Scrutiny Standard which will ask, does the government have a compelling interest to keep gays from “marrying”, and if they do is the ban against gay marriage the least restrictive means of securing that interest.
We’ll find out this summer.
“Will John Roberts decide for gay marriage?”
Probably. He’s been compromised. They must have something really serious on this guy.
Fire Island?
What’s that?
Perverts in positions of power, turning America into a pervert nation.
Who needs enemies like Isis, Putin, al-Qaeda, when deviants within our own country have successfully destroyed it?
