How could he know what? He is just saying he has experience participating in charging conferences and this could not have been carefully reviewed.
He is not declaring the accused innocent. He is saying that based on his years of experience there is no way a charge of murder can be submitted without spending days weighing the evidence and interviewing various parties. Also the Persecutor saying that she is listening to the yells of the mob is not particularly reassuring that the evidence is being cooly, or competently, reviewed.
So yes, I can understand why he is calling this a miscarriage of justice - due to the process.

He is an experienced former homicide detective. He knows the process by which charges of this magnitude are obtained. That process was circumvented in this case. As Sheriff Clarke said, there is no way that this prosecutor did due diligence on this evidence having just received this case yesterday.
Years of experience and the red flag of her saying that she heard the "protesters" voices when announcing the charges?????
