although I’m all for the protests, I’m getting confused. Obama ignores the congress and judges, can a supreme court ruling be ignored by states?
Legally speaking the States cannot.
Andrew Jackson seemed to think so when he responded to a SCOTUS ruling (Worcester v. Georgia) by saying, “John Marshall has made his decision; now let him enforce it!”
Tecnicaly yes it can be. States are under no obligation to lift a finger to enforce the edicts of the oligarchs on the court. Particularity when those edicts overturn law as written and practiced for hundreds of years.
Only the friends of tyranny could call that justice, much less Constitutional order when the nature of law can be changed on a bench after hundreds of years of practice in the other direction.
Law making is the work of a legislator not a judge. To allow judgest to issue such broad edicts in total contradiction with hundreds of years of practice in addition to the clear wording(or lack there of in power) of the Text of the law is to invite dictatorship not just or rule of law, but rather rule of men in black robes.
Rule so blatantly corrupt and open that they ignore even their own previous edicts in the interest of imposing their lawless will upon what was once a free people and nation of laws.
0bama has ignored the laws because there’s actually nothing congress can do to him... once they rule out impeachment (a fancy word for being fired). it’s up to the DoJ (and DoD in some cases) to actively enforce penalties. since the DoJ won’t do anything against 0bama... congress is pointless.
as for the states, they can ignore the laws as well... except 0bama will then sic the DoJ on them and pull them thru federal court. of course there’s no real penalty as you can’t put a state in prison. the feds could remove federal funding... which the states should do themselves anyhow.
i’m still wondering why we pay for congress... since their passing of laws means jack squat when 0bama can ignore or enforce whatever he sees fit.
