Texas Kids Told 'It's Illegal' to Sell Lemonade Without a Permit

Two young sisters with an "entrepreneurial spirit" set up a lemonade stand in Overton, Texas, to raise money for their dad's Father's day gift, their mom said.

But Andria and Zoey Green's business closed abruptly Monday after police came by to tell them their stand was illegal without a city Peddler's Permit, according to Overton Police Department Chief Clyde Carter.

"It's illegal to sell lemonade without a permit," Carter told ABC News today. "But we didn't tell them to shut down, we just asked them to get a permit."

The girls' mother, Sandi Evans, said they went to try to get a Peddler's Permit at City Hall, but found out they'd have to get licensed by the Rusk County Health Department before being allowed a Peddler's Permit.

"Once we found out everything we would have to go through, we just decided to stop technically selling the lemonade," Evans told ABC News today. "The girls are still going to have the stand, but they're just going to ask for donations instead."

The lemonade stand was an American institution, the training wheels of capitalism. The kids are learning a different lesson now as the State crushes initiative and demonstrates its authority to intervne in the smallest aspects of their lives. Damn those petty tyrants!

All they had to do is donations only and they would have been ok. Probably would have made more money that way anyway.

Our family was at an outdoor jazz concert in the park, held by the city every summer. A woman and her young daughter set down on a blanket near ours, with a huge ice chest and supplies. The young girl started walking among the crowds sitting on blankets, and sweetly asked if they would like some free lemonade, and they could donate if they wished. No one could resist her charm, and we as well as others donated far more than what a cup would normally cost. Little girl sold out quickly and made a fortune. All legal.

Excellence: A sole proprietorship is a business.

Well yes and no. A sole proprietorship is actually a business operation conducted by "persons" or "individuals." So, while the sole proprietorship is not itself incorporated, "persons" and "individuals" are actually people who are operating in commerce in such a way as being presumed to be personally representing corporate operations.

That's why they avoid double taxation, but still have to personally pay according to tax schedules set up for corporate entities of one kind or another - in their particular case, the "incorporated entities" known as "persons" or "individuals" acting without any other corporate structure.

You will notice that no tax code references "people," "men" or "women." That's because those are not incorporated entities, but specifically non-incorporated natural human beings.

Not that any of this matters - Courts do not give standing to natural human beings acting without corporate affiliation. So there's no way to plead non-corporate standing anyway. That's right - you literally cannot get any Court to acknowledge you as a non-corporate human human. If they commented on the subject at all (and they won't) they would tell you they don't have the authority to do so.

That's why this information is for research only, good for pressuring lawmakers to pass laws creating processes by which Courts must acknowledge non-corporate status, but that's it. Trying to use this knowledge directly would be suicidal - the Court will simply presume you are corporate for showing up to complain, and then let the government prosecute you as a corporate entity, and win. Happens all the time - every time. So don't try it (you're warned).

That is a cowardly statement. Maybe the British should have just asked for "donations" for their tea, then there wouldn't have been a reason for the colonialists to get "their panties in a bunch".
