RUSH: I checked e-mail as I always do during the break. "Rush, why are you so sure" -- this is several e-mails -- "Why are you so sure that the court is going to legalize gay marriage nationally?" I had a bunch of people want me to explain why I made the prediction. After today, I don't know how anybody could doubt that's going to be the result, but let me give you a practical reason why. How many times have we joked on this program about Justice Kennedy being the subject of profiles in the Washington Post Style section or the New York Times Sunday magazine to influence him and so forth, and Chief Justice Roberts, too?
Well, this past Sunday, I don't know if it was the Sunday Times magazine or just the newspaper itself, but there was this fawning profile. I mean, you could have put this profile on your pancakes it was so syrupy about Justice Kennedy and his days in Sacramento. Now, I happened to be working in Sacramento at the same time Justice Kennedy was there. In fact, we both left Sacramento, he for Washington, me for New York, the same year. You know, when the Bork nomination was rejected, Anthony Kennedy got in there. Ginsberg was gonna get it but then they discovered he had blown the evil weed at some point in his earlier life, so he's disqualified.
So they found Justice Kennedy, McGeorge School of Law in Sacramento, and in Sacramento McGeorge was a big deal. The dean at the time was a man named Gordon Schaber. And Gordon Schaber was a closeted -- said the New York Times. I did not know this, it didn't matter to me, but the New York Times reported Sunday he was a closeted gay man. And there were rumors at the time, everybody I think knew it, rumors of who his boyfriend was, partner.
Anyway, the New York Times story just ladled it on about how Gordon Schaber and everybody deeply sensitized Tony Kennedy to the gay life, deeply sensitized him to the problems of having to stay in the closet. It detailed many social evenings where Tony Kennedy was a guest at gay dinner parties and how everybody was just so pleasantly surprised at how accepting he was and nonjudgmental he was.
Now, I'm reporting this without the story right in front of me so I'm giving it to you paraphrased. That's pretty close to the tone of the piece. Well, folks, I mean, it's clear as a bell that that piece isn't gonna run if -- (laughing) -- if Kennedy is in the dissent on gay marriage. There's gonna be a revolt at the New York Times. I mean, there are just things that happen that give you an indication of what's coming down the pike. I would make the prediction even without the New York Times piece this past weekend, based on everybody's past ruling, just based on the inertia of where we are headed right now as a culture.
I'd be willing to see it, but somebody point out to me where the brakes are being applied here. I don't see anyplace. So why should the court -- that's not this court's job. This court has made it plain that it's going to survey public opinion and get right in line with it. Or what they think is public opinion. Here, let me give you just a little sample from the New York Times story on Justice Kennedy this past weekend.
"Now, as the Supreme Court prepares to rule on whether to grant a constitutional right to same-sex marriage, Justice Kennedy, a onetime altar boy, has emerged as an unlikely gay rights icon. At 78, he has advanced legal equality for gays more than any other American jurist, making his friend Mr. Schaber," the dean of McGeorge Law, who has since passed away, look prescient. Meaning Schaber is largely credited for convincing the Reagan administration to pick Tony Kennedy to sit on the court.
Justice Kennedy invited me to attend a Margaret Thatcher lecture with his family in New York one night, and I knew his son Justin for a while. They're fine folks. I don't want anybody to misunderstand what I'm saying here. I'm not saying anything more than what I'm saying. People want to know why do you think the ruling's gonna be what it is, it's staring at us, it's right in front of our face. You don't need to be prescient. All you have to be is be aware. I don't think there's any doubt.
I also don't think there's any doubt that they waited until the last two days of the term to release these two things. This is called flooding the zone. I don't doubt that there's strategy in this.

Reagan, Bush I, and Bush II had the opportunity to appoint a real conservative jurist, J. Harvie Wilkinson, to the Supreme Court. Unfortunately Wilkinson didn’t attend an Ivy League law school which seems to be the primary criteria for appointment. Wilkinson has publicly stated the issue of gay marriage is a legislative, not judicial issue. In Richmond Medical Center For Women vs. Herring (2008) sitting on the Fourth Circuit Court of Appeals where he is Chief Justice, Wilkinson wrote the opinion upholding the Virginia law prohibiting partial birth abortions.
Somehow Republican presidents seem to pass over the reliable conservative jurists in order to appoint “moderates” who turn left such as Earl Warren, Harry Blackman, John Paul Stevens, David Souter, Anthony Kennedy, and John Roberts.
Elections have consequences. However, a GOP president will not necessarily ensure a conservative Supreme Court appointment. Earl Warren, Harry Blackman, and John Roberts were all appointed by the GOP and they have done as much or more to destroy the Republic as William O. Douglas, Stephen Breyer, Elena Kagan or the wise Latina.
If John Roberts and Harriet Miers were considered great jurists by George W. Bush, one can only imagine who Jeb would appoint to replace Scalia. Likely he’d let Chuck Schumer choose another Harvard or Yale leftist in the spirit of bipartisanship.
The calls to relegate the Bible to museums, as they’re doing with the flag, will begin immediately after the ruling is handed down.

According to the polls, the majority opinion of support/opposition of so-called "gay" so-called "rights" by the public at large has swung 180 degrees within the last 2 decades. I fully realize that my bible-based position on the issue is at odds with the views of well over 1/2 of the American people nowadays, but I would much rather be on God's side of the issue than on old smutty-face's side.
And let no one be deceived by the pro-homo propaganda that claims homosexual "love" is as pure, natural, and morally acceptable as God-ordained love and marital relations between the 2 opposite sexes. The truth is exactly the opposite, the bible condemns homosexual sin and cites it as one of the primary causes for the flood of Noah's day and time. The bible also tells us that the next cleansing of the earth will be by fire instead of by water, and I can't help but believe that God's cleansing fire is being kindled even as I type.
John Roberts is obviously a GAY man who ILLEGALLY adopted his two children and is being BLACKMAILED!!! There is NO OTHER explanation !!!

I, for one, thought John Roberts was BRILLIANt when I saw him in front of the Democrat Senators.....now I know he was just more EVIL than they were.
It’s over. The Constitution is dead.
And since it is dead then all the laws based on it are now moot. Which means murder, robbery, etc. are legal since the basis for laws against them are in the federal and states constitutions. We now know states no longer exist.
It now comes down to who has the most weapons and are willing to use them.
