Supreme Court ruling on gay marriage may pave way for expanded gun rights

With the high court’s latest ruling on same-sex marriages, some contend the decision could lead to increased gun rights, specifically national CCW reciprocity, by using the same argument.

Friday the U.S. Supreme Court ruled 5-4 that the Fourteenth Amendment requires a state to license a marriage between two people of the same sex and recognize those sanctioned by other states.

“No longer may this liberty be denied,” Justice Anthony M. Kennedy wrote for the majority in the landmark decision that arguably made same sex marriage a reality in the 13 remaining states that continued to ban the practice.

With similar logic applied, gun rights advocates argue that the nation’s patchwork of firearms laws governing the concealed carry of handguns are now circumspect under the same guidelines. In short, they reason if marriage equality is guaranteed from state to state, then so should concealed carry rights.

“To paraphrase what Associate Justice Anthony Kennedy said about same-sex marriage,” noted Citizens Committee for the Right to Keep and Bear Arms Chairman Alan Gottlieb in a statement Friday, “no right is more profound than the right of self-preservation, and under the Constitution, all citizens should be able to exercise the right of self-defense anywhere in the country. It disparages their ability to do so, and diminishes their personhood to deny the right to bear arms they have in their home states when they are visiting other states.

Don’t bet on it. I expect District Court decisions are going to go increasingly against gun rights and precedent won’t matter even a little. Then the Supreme Court merely declines to take the cases (same with 1st Amd cases). They will accelerate now after the gay marriage decision. The District Courts now are almost all Obama courts. Conservatives’ representation in Washington is effectively limited to three Justices. How long will that last? The Democrat majority is permanent. The list of new Justices who have migrated from the Left to the Constitution is pretty short. It has, in fact, no names on it.

I would avoid bringing any 2nd amendment case in front of this group. I’m convinced Roberts has been compromised. If “state” doesn’t mean state then “shall not be infringed” can mean “easily be infringed”.

We thought we had a conservative majority. We don’t and that is VERY dangerous.

... if marriage equality is guaranteed from state to state...so let's see if I understand this - when over thirty states had established laws and state constitutional clauses in support of traditional marriage, this was seen as illegal under the federal constitution by a gaggle of federal judges - until a majority of states were declared to have legalized same-sex marriage by judicial fiat - so now the federal Supreme Court can declare that since a majority of states have said same-sex marriage is legal, all states must approve it - nope, sorry, still doesn't make sense in any rational way.....

This court very definitely would arbitrarily apply a totally different standard to any gun case - but didn’t the DOMA ruling set a precedent whereby going to the supreme court would probably be unnecessary? The 2nd amendment is alot clearer and unambiguous than some equal protection clause.

I want Vermont’s Constitutional Carry to be reciprocated in all states and territories. No licensing required for the God given right to defend yourself, your loved ones and your property.

Nonsense. The Supremes will do whatever they want. The plain words and meaning of the Constitution is no longer an impediment to their tyranny. All they need is 5 in agreement to rule this country of 330 million people and to hell with what the people want through their elected representatives much less what the Constitution actually says and means.

The Court has just proven they can and will make up whatever they want and get away with it. Expanding the 2nd Amendment is not in the cards. If anything, they will start banishing it and they will do it quickly. No actual rights we think we have are safe from six of these black robed bastards. All they need to do is cobble together 5 of the 6 and reign as they wish.

With Sotomayor and Kagan being queer, it was a no brainer they’d both vote for same sex marriage! I was hoping though that Kennedy would not have capitulated.

More likely that other States that decide certain perversions are fine with them will get those same perversions passed along to the other States as "liberties that cannot be denied".

They will find a line of "reasoning" to tell us why them evil gun-toters don't qualify for the same considerations.

I believe in the Bible and I believe what we are seeing is an acceleration of the ills the world will suffer before Jesus comes back. We will not be able to subvert what God has ordained so it is time to focus on our own souls and our families, then carry the Word - He has spoken and we're spinning our wheels by trying to turn it around.
