22 states sue EPA over water rule
The Washington Examiner ^ | June 30, 2015 | John Siciliano

The regulations extend the EPA's and the Army Corps' regulatory reach over what is termed "navigable waters," which ranchers, farmers and states argue gives the federal agencies' unprecedented authority over drainage ditches and nearly anything else that can contain water.

"This rule is a staggering overreach by the federal government and violates the very law it claims to enforce," Morrissey said. "It will have dire consequences for homeowners, farmers and other entities by forcing them to navigate a complex federal bureaucracy and obtain costly permits in order to perform everyday tasks like digging ditches, building fences or spraying fertilizers."

The litigation included West Virginia, Alabama, Florida, Georgia, Kansas, Kentucky, South Carolina, Utah and Wisconsin.

The lawsuit argues that the rule violates the Constitution, the Clean Water Act and the Administrative Procedure Act, and "usurps the states' primary responsibility for the management, protection and care of intrastate waters and lands," according to a statement from Morrisey's office.

The EPA will be able to impose huge fines on landowners over mud puddles if this stands. Some of these states have Democrat governors, too.

Also, if the Feds had this much control over water, imagine what they could do with it. Remember what the IRS did to groups whose politics they didn’t like.

This is far more important than gay marriage. We’re being distracted by social issues, which matter but are largely personal in nature, and are missing things that change our future for the worse, like this, Obamacare, and that awful trade agreement that was recently passed.

Well I was wrong. It should be all 60 states should object.

In this video clip Obama says he has visited all 57 states except one, and of course he wasn't allowed to go to Alaska or Hawaii, because his staff wouldn't justify it. (Whatever that means)

So 57 + 1 and Alaska and Hawaii.

60 states...

I was thinking the same thing. My state wasn’t included in that earlier list and I was kind of annoyed.

Ben, while I agree in principle, that would allow the feds to come in and pick states off one by one on certain issues.

Best to simple get the Feds declared to be over-reaching and end it once and for all.

Of course if that doesn’t work, then the states could simple thumb their nose.

North Dakota led a group of 13 states Monday in a lawsuit...
-
North Dakota
Alaska
Arizona
Arkansas
Colorado
Idaho
Missouri
Montana
Nebraska
Nevada
South Dakota
Wyoming
New Mexico
-
(that was the first ‘13’)
West Virginia led the charge with eight other states in a separate court filing...
-
West Virginia
Alabama
Florida
Georgia
Kansas
Kentucky
South Carolina
Utah
Wisconsin
-
(13 + 8 = 22)

Even with 22, that still leaves 31.
