Can Kate Steinle's Family Sue San Francisco Over Its Sanctuary City Policy?

Kathryn "Kate" Steinle was shot dead on July 1, allegedly by Juan Francisco Lopez-Sanchez, a Mexican felon who was in the U.S. illegally. Lopez-Sanchez would have been deported but for the fact that San Francisco is a "sanctuary city," which is why officials there chose to release him and ignore an ICE detainer. This effectively put him back on the street. And yet, if Steinle's family tries to sue the city for this travesty, it may be thrown out of court.

Welcome to Acirema, where the guilty are rewarded and the innocent are punished. The half breed flaunts any and all laws and court rulings count for nothing. CO flaunts federal marijuana laws without consequences. SF and other sanctuary cities flaunt immigration law without consequences. What laws can I break without consequences?

BTW, any lawyer who would argue “It is commonly known that we have been a ‘sanctuary city’ for years. If this was a problem for the victim, she should have lived somewhere else.” deserves to be disbarred and committed to an institution for the criminally insane.

Could you post the constitutional authority which gives the feds the power to outlaw drugs or better why CO law doesn’t supersede the feds under the 10th amendment?

Doesn't the idea of mitigation of damages imply reasonable mitigation actions? Mitigation of damages doesn't require extraordinary mitigation efforts. If I were an attorney, I would be willing to let a jury decide if moving away from the city is a reasonable mitigation expectation. Assuming you can find 12 reasonable people in SF (a big assumption), I guessing the jury would say no.

Better still can the city counsel members who voted in the sanctuary policy and the mayor who signed off on it be charged with murder too. They are most definitely compliant in this crime. And don’t leave out the DA.s and police chiefs either.

For peet’s sake, this family just buried their daughter! It would have been a huge mistake for Trump to make a public visit at this time. I hope he’s offered condolences privately, everything shouldn’t be political!

You are close, Sue in Federal court as San Fran is in violation of Federal Laws.

There is a Supreme Court case ruling that says the police are not obligated to protect you. They are only there to enforce the law. If they caught the guy, then they “enforced” it in their eyes.

I believe that some states have laws that cities cannot be ‘sued’. I seem to remember some case in Atlanta about suing the city for wrongful acts.
