Twin Peaks Biker Files Objection: Waco PD Grand Jury Foreman has Conflict of Interest

Christopher J. Downey is a former Harris County prosecutor who worked in the Civil Rights Division of the Harris County District Attorney’s Office. The now criminal defense lawyer has both presented numerous shooting cases to grand juries, and defended police officers on shooting investigations. As a prosecutor he investigated whether any laws were broken or civil rights violations occurred during a police shooting. He is of counsel to a police union, the Coalition of Police and Sheriffs (C.O.P.S.). His job now is to go out on calls when a member shoots someone.

Downey told Breitbart Texas, “The role of any grand jury is to review the assertion of law enforcement that there is probable cause to justify prosecuting an individual. Grand jurors enjoy the unique privilege of total secrecy in their deliberations but in that unique privilege is the assumption that the grand jurors are unbiased.”

“Selecting a grand juror in any case who has prior knowledge of the facts of the case, or allowing a police officer to serve as foreman in a matter that involves allegations of police misconduct, invites unnecessary allegations of bias. It undermines the integrity of the system. To do so in this case, in a case with national attention, is patently absurd,” said Downey.

First I notice you've reduced your original 'nine dead' by state forces assertion to a 'majority' killed by state forces, which is a good start. It demonstrates an acknowledgment on your part that bikers killed bikers and it wasn't a police massacre.

No, it doesn't. A massacre was committed. Nine citizens of the United States are dead. There is no incontrovertible proof of who shot who at this point. Published autopsy reports that are available at this time are not without dubious findings (link).

So the question becomes who shot first, the police or the bikers?

I disagree. The question of who fired first does not satisfy the outrage and anger over massive violations by the State of nearly every Amendment with concomitant death and devastation.

I've read at least a half dozen separate eye witness accounts of the shootout and every single one of them supports the notion that bikers started shooting at each other first. Absent evidence to the contrary I have no reason to disbelieve them. Eyewitness accounts show at least four bikers were killed by other bikers.

Would that excuse violations of civil rights conducted after the heat of the moment or fog of war or confusion or battle or exigent circumstances?

Turns out they were all members of the same 3% club who got caught up in police dragnet around Twin Peaks and then let go once it was determined who they were.

Excellent post Sir! You really nailed most the important points about this tragic event and treatment of American citizens.

I have TG blocked so I didn’t read his replies but I can imagine he is still as dense as a block of lead. He’s a liberal and we all know or at least suspect liberalism as being a mental disease. With TG there can be no doubt.

Yes, that’s how the process starts. If Peterson denies the motion, then Broden appeals. That’s how Zimmerman got judge Lester removed from the case.

That is the patch of the In Country MC.

They state they are a 501c(9) tax exempt organization. I have no information on their club other than what is publicly available on their web site or as may be mentioned (correctly or not) in news dispatches.

I have no knowledge of their club business and have no opinion on their club or members.

Law enforcement is equipped with light infantry weapons - namely, select fire rifles as well as concussive explosives and other military gear including ballistic armor.

Good...you'll be pleased to know that the McClellan County Sheriff Parnell McNamara has just made a request for a couple of dozen AR15s for his department as well.

This request was made in the wake of an incident where a county man armed with an AR15 and shotgun was shooting into a woman's house.

Apparently the local MC was unavailable to help her.
