Well, the first question is this -— has the matter been referred to the U.S. Attorney for D.C.?

Secondly, Is the U.S. Attorney for D.C. an independent entity or are they under the DOJ?

I doubt it. Ninety percent of what goes on in the Capitol is kabuki theater anyway.

I believe all U.S. attorneys are under the DOJ. But they don't have a choice. If the matter is referred to them then they have to go to a grand jury.
