Five of Rowan County Clerk Kim Davis’ deputy clerks have said they are willing to issue marriage licenses. Judge David Bunning said that would purge the contempt charge against Davis.
Nathan Davis, Kim’s son and who works in the office, was the only deputy to refuse the judge. The others still cited concerns a mix of religious objections and questions about their legal authority to sign off on forms without say so from Davis.
Attorneys also called into question whether any licenses issued in Davis’ absence would be legal.
Bunning said couples would have to judge that risk on their own. He indicated that he would lift the contempt charge against Davis if deputies began issuing forms, but he said he was reluctant to release her too quickly.
Bunning said he didn’t want her to return only to re-implement the policy and create a “ping pong” match in the courts.

Kentucky law does not allow the deputy clerks to sign any marriage licenses.
This Fed judge is now making up administrative law rules?
Someone in Kentucky's State court system has to step in here.
Otherwise they can all go home and let the Feds administer the State.
Bunning is making a mockery out of this whole thing, exceeding his authority right and left.
