Based on the Supreme Court ruling on marriage, I can see that we have a conflict here.

What I don’t understand, and may never understand, is why she is in jail.

What crime has she been convicted of? What violent felony has she been accused of, that she needs to be in jail awaiting trail?

When is her trial scheduled? Is she even going to have a trial, or just be behind bars indefinitely??

Her attorneys will be filing a writ of Habeas Corpus any day now. Show cause and authority for detaining her - and “Because I said so” ain’t a good enough excuse. (At least it didn’t used to be...)

You ask the questions many FReepers are unwilling to discuss sensibly.

My original question regards why she is in jail and 0 is not? Both officials have selectively chosen not to enforce certain "laws" and have announced their intentions.

Courts have the inherent power of incarceration, without resort to any statute at all. If you refuse to do what a judge says, you go to jail until you comply. That is called "civil contempt."

This judge ordered her to violate her religion (or choose between it and working for the state in this capacity), and she refused. That is classic contempt.

There is no definite time limit, although the legal principle is that a judge must cease incarceration when it is clear that incarceration will not produce compliance. That is a battle of wills. The judge sees the law as superior, Davis sees her religion as superior.

This is typical judicial behavior - they are arrogant bullies, using "the law" as some sort of be-all, end-all.

She is being held in contempt of court. Apparently they can do that, and keep her there until she gives in. No matter how long it takes. There was a story here last week of a man freed after being held in contempt 14 years.

The crime of “Pi$$ing off a Judge.” These people think they’re more important than God. They will ultimately “discover” that they were wrong. In this case, I just hope he “finds out” sooner rather than later.
