Kim Davis always has the “conscientious objector” option of giving up her job. Why wouldn’t she do that?

Because she doesn’t have to. SCOTUS ruled that the 14th amendment conflicts with the 1st. The constitution says no public office can be subject to a religious test. Therefore, saying she has to resign means there is an unconstitutional religious test against Christian belief for KY County Clerk.

Further, the relief she has sought was to have the marriage license altered to remove her personal name as county clerk, not to refuse to issue licenses.

She never filled out an employment application.
She is not an employee.
She wasn't a political appointment.

She was elected!

Every citizen who voted her into office is sharing her jail cell.
