Any time a government official is sued for failure to evenly apply a law, the courts dismiss the suit because the government has "prosecutorial discretion" and other prerogatives.
This "law" or principle does not apply to Kim Davis' higher-ups obviously. High-ranking US officials have declared they will not enforce selected "laws" and THEY do not sit in jail.
(This tyrannical system and the individuals wielding their own usurped authority unjustly will receive their due recompense at the appropriate Time and Place.)

Right. I was explaining how (one way out of literally hundreds) the judges see to it the laws are "lawfully" selectively enforced.
